      Replace "know" with they are assuming and you got it. Many other legal teams have made the opposite conclusion. No one really "knows" anything until the fat lady sings in court. The best risk mitigated decision would obviously be to maintain status quo and not mandate.

              By your logic they don't "make" you do anything, yet they still get sued for lots of things and pay. Had a coworker fall off a bridge doing what he was told to do. Company paid... big. They didn't "make" him do it. He had a choice. Do it or go work somewhere else. He did it, he fell, and they were held accountable.

                I took a pay cut a couple years ago, this wasnt a condition of my employment. I mean, other than take the cut or go elsewhere.

                  Then your company is not very sharp. My company has a system called Stop Work. You can refuse to not do any task you deem as not safe. If you do something in the scope of your job and get hurt, that’s on you and you will lose your job.

                      Most people don't realize these "incentives" were just to show that the employee "made a deal" and wasn't coerced or threatened.

                        Mine is over a billion as well. If pushed out, my LinkedIn will detail why I’m unemployed and that no exemptions were accepted. Pushing a guy on chemo out the door - that’s good PR.

                                the easiest way to understand it is it wasn't a condition of employment when the employee was hired. They can and will get sued over wrongful termination. The employee will win.
