Was the tree in the parkway by chance, if it is it isn't even your tree. I'd let her car insurance cover it. Looks like she was parked illegally anyway. Maybe if she wash it would not have happened...

Youre good as long as the tree was not a hazard, ie dead/dying/etc

Not unless you had notice that the tree was in bad shape and you failed to do anything.

            Or
            Liability on ur homeowners
Liability for him is very unlikely.

            Not going to happen, basically

Lot of trees around my hood have fallen over too.

Did you loose power? We did in the wee hours for several hours> Thankfully it's back on now.

You don't have anything to worry about as your insurance does not come into play here - here insurance will cover the damage (whether they cover it under comp or collision will be the big ? for her)

My best guess would be that it would be covered under Comp

Nope. Act of God. Unless she can prove your negligence somehow.

                    Comp coverage under her policy.

But I would not touch the tree until her company comes and looks or you could possibly be liable for damage you cause by trying to remove it.

                      Did you have
A No wrong way parking sign posted?
A beware of falling tree limbs sign?
A watch for frozen tree sign?
If you did not warn them you are ok. Its only when you tell them all these things and they still do it ???????.
Her insurance should cover it. She was parked on a city street?

insurance will most likely call it an Act of God

She can sue the city for having the road too close to the tree...

I second the "don't touch the tree". I know it's neighborly and all, but I'm sure that they could say, he cut this one branch and the rest caved in more or something.

Went out to my truck and my Red Oak took a beating. Lucky no damage to my truck. I've been cutting and clearing my driveway and trying to clear the street as well. My wonderful neighbors stood out front of their house and watched me work.

Guess my plumbers crack was exciting to them. I cannot remove any more branches from the tree or it will cause more damage to the car. Not sure how I am going to get it off her car.
