    I was just told by my neighbor that her roommate has filed a claim, but also they(insurance company) told her that I better have home owners insurance. I said I am not responsible for acts of nature.

      your fine unless you had already been told and or knew that the tree was dead or dying as mentioned above by so many... You will have no liability in the issue

      Been doing this over 15 yrs- i promise most of them are telling you correctly- some are not

          you would be shocked how often stuff like this happens, we paid for a car port of a neighbors a few weeks ago- then when our client tried to have the dead tree cut down by a friend we paid for the rest of the car port when it was totalled

          Neighbors fight like crazy over stuff like this. Have a open lawsuite claim right now over a fence repair that was couple hundred dollars and now thousands in court. Stupid people!!!

                i have had this happen, my tree fell on my neighbors rv during a storm, insurance said it was act of nature. her insurance paid for the damage.

                    She just came over and said she is paying her $500 dec and her insurance will take care of it. They have ask me to get the tree off her car so the adjuster can get inside to inspect for damage.

                        "YOU" shouldn't have to lift a finger and "they" can't ask you to do anything but assist as a neighbor. Being neighborly is fine, as long as they know you are "HELPING AS A NEIGHBOR" to remove the tree, not because you're liable.

                        Also, DO NOT call your HO Insurance. Let her insurance company handle EVERYTHING.

                          I have not called anybody and I have made it very clear my position. She understands that and I have taken all kinds of pictures. That car has dent in the roof and the back right quarter panel.

                              The right thing to do is to get the tree off for her.

                              But her carrier owes a reasonable amount for the removal. Probably about five hundred bucks

                              Now I will say that every situation is different. I was involved in a case years ago in Texas where our insured ended up paying the deductible for a trampoline that damage the neighbors house. But it wasn't the first time the trampoline had moved in the wind and the deductible amounts were much higher. My carrier paid the deductible of about three grand in exchange for a release from the other company. And the neighbors remained friends .... (Oh by the way, they were both lawyers.....what a pita....)
