        I think there are five current lawsuits being filed in federal court in New Mexico to enjoin (issue an injunction) the emergency declaration.

        Even when the 30 days expires, I am fairly certain that the issue doesn’t end and can be allowed to go forward. That is because she could again issue some kind of emergency declaration.

        So my prediction is an injunction halting the order in NM from a federal district judge. NM will fight the injunction and appeal to the 10th Circuit who will uphold the injunction. In doing so the Circuit will not hear the full case/arguments but simply stop its enforcement temporarily. If it is actually later argued in the Circuit then lawyers from both sides will get their day in court. A final ruling will be issued removing a governor’s authority to suspend the Second Amendment, in my opinion. An appeal to the Supreme Court will be denied which will end this shenanigan.

        This move by the governor might force the issue and sooner rather than later. I suspect that she might have set in motion an end to such acts.
        They must have been getting premonitions about what was about to happen or reading my comments.

        Personally I think the governor met with some fairly high level Democrats (or phone calls) who told her to shut this fiasco down. It was about to start the ball rolling downhill and it couldn’t be stopped.

        So now the governor has rescinded her order except for parks and playgrounds,.. you know, where all the gang violence is happening.

        I believe they saw some bad handwriting on the wall and are trying to stop it. By ending her order is likely an attempt to stop the lawsuits from going forward and getting a terrible ruling from their point of view.

        The courts could rule to allow the issue to go forward but they might kill it.

        In Bruen SCOTUS made reference to “sensitive places” like courtrooms, etc., where it would be permissible to ban guns but not in the general public. In one section of Bruen it mentions that New York wanted to ban guns in Manhattan because it was so crowded. The Supreme Court’s response was that being crowded does not make a place sensitive. I think that alone or shoot down the parks and playgrounds ban by the governor.

        However…..

        She (and the likelihood of Democrat operatives behind her telling her to shut it down) want to change any court challenge away from declaring a state of emergency can somehow ends constitutional rights to a sensitive places fight. They almost certainly know that they will lose the sensitive places ruling but that is a minor loss compared to a sweeping ruling that a state of emergency doesn’t end constitutional rights.

        Like I said, in my earlier statement that I quoted, this could turn out to be great. She really stepped in a big pile of it and they are realizing what she set in motion.

            Yes this was the long game for the Dems all along. This NM tool just got out over her skis too quickly. The need this to calm down so as to implement it later for Climate Emergency, Covid Emergency, Electrical Grid Emergency and so on. They do NOT want a ruling this quickly. It still won’t stop them but may make them pivot….slightly.

                  I agree that she should be replaced but this is a political stunt.

                  IF…. NM allows for a recall (I believe that most states do not), that would seem to be a better option than to get politicians from a party to cross the aisle.

                  It seems like a lot of people from a wide cross section are extremely displeased with her antics and that might make a recall a viable option.
