Ask your best friend how he can plead to a case that has never been filed.

[QUOTE=djs303;14925655]Keep checking back with the court and keep good records on who was spoken to for future recall as most courts dont have any record that the court was contacted unless there is a complaint on file.[/QUOTE

Too bad you can't set up a robo call and make it every 15 minutes.

This ^... and I don't know a single judge that would ever dismiss based on speedy trial before the case is even filed (it usually takes years before speedy trial becomes a viable argument). Not to mention inability to conduct a jury trial due to a pandemic is a slam dunk reason not to grant a speedy trial motion.

Several years ago, I received a ticket from a State Trooper. I kept contacting the office on the ticket I received. After about a month or so it was eventually dismissed because the trooper never turned in the ticket or didn't do his part.

Just to clarify, the speedy trial statement was made the day after the ticket was received. Now that the due date has passed, he said it’s on their part to contact my son.

You may want to avoid future advice on this matter from the “da” friend if he/she truly told you that.

The burden being all on the individual is ridiculous. How is there not a cutoff date for tickets being turned in to the court?

Also, never trust a court to call you. I got a warrant in the mail for a matter that was supposed to be resolved. They said someone should have called me but they were not sure if anyone did.

I got a ticket for no seat belt once. But the copy I got from the officer didn't have the violation on it at all. When I showed up to court, I asked what the summons was for. The judge told me for a seat belt violation. I showed him my copy that the officer gave me, but the judge blew it off and said "this is the courts record" as he held up a sheet of paper. I asked the judge how was I to know what he put on there was accurate. He responded by saying the his officers were honest. I then asked if the officers had lockers at the police station, he replied yes they did. I asked if those lockers had locks on them, to which he replied yes. I asked if no one but officers were allowed in the locker area, he said yes. I asked then if his officers were honest, why did they need locks on their lockers? He dismissed the ticket.

Don't contact the GW. I would go back and request to see the judge. Demand it if necessary. When/if you talk to the judge, ask for a record of you appearing for your records. Then, once you have that, don't show up again unless you hear from the court. Just like it's your responsibility to appear "on or before" the date on the ticket, it's their responsibility to file the complaint on time. It's not your responsibility to keep showing up until the ticket is filed. You fulfilled your obligation, they didn't. Ask for a dismissal.

Every paper ticket I received in small towns. I just paid cash for, especially Martindale, oddly never ended up on my driving record.

My son got a speeding ticket in Lake Charles in March, and they kept telling him the same thing. Well, they found it in June, now he's got a court date next week.

                          Not very good advise...

As soon as the complaint come in that your complaining you bet your *** the Game Warden will make sure the ticket gets turned in. My .02. Let it play out as it may get dismissed.

Prolly best advise. I know it may seem like a pain but this is the best plan to getting it dismissed or it never showing up.

I lived in Fentress in 1993 and remember that Martindale was well known for being a speed trap.

There is a cutoff date. It is two years from the date the offense was observed.

This happened to me before and I thought the warden had a change of heart....lol He ended up turning in ticket. Sometimes it just takes awhile for whatever reason, but you can bet if he took the time to write out a ticket he will turn it in.
