I'm done with it to be honest. Its cost me already the equivalent of 4 days of work. I had to burn 2 of my vacation days. I knew I was right, and i stand up for that. The judgement was in my favor, and that's what I wanted. Was the officer acting like a loon that day, absolutely. But I have to be done w it.

I've never been in this situation so excuse my ignorance but couldn't you sue the department in civil court to recoup the value of your lost time to defend? Seems pretty open & shut given your acquittal and they would probably settle out of court just to make it go away.

WOW. Did the judge react to that?
Would definitely get a transcript of that

Boom! That right there is exactly what I would be doing. They will settle out of court because they know you will win that all day long.

I've thought about it. I may try it. Me missing work and having to use my vacation days cost me around 1500 just to represent myself. My wife doesnt work, she takes care of our kids. So it does eat into my funds.

I don't pretend to know your financial situation but not seeking restitution from the Department pretty much means "you won" but still paid a $1500 penalty to say you won.

I wouldn't get greedy. Just enough to cover your lost compensation, including vacation days. I feel you should be compensated, especially since the officer knew that equipment was faulty. Of course, we all make mistakes, but sometimes those mistakes cost money. I'm not sure how points and CDL work, but you did the right thing and proved you were innocent.

I agree! Kinda makes it a hollow victory

This was my thought. Either way, you still lost money. The ticket would have cost you money as well.

Yeah your correct. Even though I won on the ticket I still lost financially. I let the court know that today also. Having a cdl your forced to fight it to keep it off your record. I actually use my cdl for work everday, not for fun. The whole reason to fight is to keep it off my record, a ticket on a cdl holder lasts 5yrs now!

Trust me 1500 is nothing to sneeze at. I work my butt off. I just dont want it to cost me more time and money to continue to fight.
