No, but the lost hard drive definitely is... The emails are (should be) saved on a server, not exclusively on her hard drive.

Once gain, as much as I'd like to see her go down for this, that's not entirely true either. Many government agencies, whether state or federal, do not back up their email servers (Microsoft Exchange) because it opens them up to the open records act. If the user elects to have their email pulled from the server to a PST file, it resides in the PST file and is moved from the server. I actually do mine this way for the most part. If I accidentally delete a PST file my email archives are gone (I back mine up).

I am not saying that Lerner did this though. They've not stated how it all happened publicly. But since the server's not backed up (I make this assumption) they can't go back to a date and restore a mailbox.

What a waste of time. Both parties are responsible for the targeting. Probably all communicated via email. We as subjects are not privy to that info. If anybody tries to challenge the establishment they will make you the villain and put you down. To many people treat the government like a god.
