    oooookkkk......


    SOOOOO... new legislation removes LEO signature... That makes filing as an individual possible for me.(Formerly ours flat refused)


    So with that said, I know pretty well the process for filing as a trust...

    What the heck is the process for an individual??? What are the pro's what are the con's?

    If you go with individual the you are the only one that can use it. If you go trust them you make friends and family on your trust and they can possess and use it legally. Plus it is still going to be at least 180 days til any new changes so do it now with a trust and be done
    Just buy all that you want before it gets more difficult and they require fingerprints and personal info from people on the trust

      What I am hearing is 41P/41F doesn't go into effect until 180 days after it is filed in the Federal Registry. They are predicting it will be filed in the Federal Registry sometime in June or July. If that is the case then none of this will matter until approximately a year from now. CLEO signoff for individuals will still be in effect until then.

        I read it will TAKE EFFECT in 180 days...


        And Lets be clear, No-one else CAN USE the can if its filed individually???? I'm not saying your lying, but I don't believe that. Possess it, transport it ok... But if I'm there with whoever and they shoot the rifle it is on. No way that in itself is a breach...

        Now if they drive it home from the ranch and you aren't there... then yeah I get that

          It does state 180 days after listed in the federal register. I have no idea when that will be or how to even check?

          "Effective Date: It will not take effect for 180 days after publication in the Federal Register. I checked the Federal Register this morning and there was no notice regarding ATF-41p. Hence, the exact effective date is still unknown."

            If you leave it in a safe at the house and your wife is alone and knows the combo to safe..... against the rules.

            Do a search for it Mike D has several posts with the benefits of a trust. For an extra couple hundred it's really a cheap peace of mind.

              I'd like to see if someone can cite the law on this one, because I don't believe that sounds right. And if so the federal courts do not have time for things like this, you would have to be escaping a much higher charge before they would waste their time on any of the license violations. I have seen the gun cases the Feds decline to prosecute, I'm not worried about something that small.

                There are a lot of people who sell trusts on here that are trying to make a case and some sales, just be cautious of what the motives may be. A car salesman is going to tell you you need a new car

                    41P was proposed, 41F is the final ruling. It is 180 days after being filed in the Federal Registry, not 180 days from Jan 4th. No one knows when that will actually happen. I am seeing people in the biz, including NFA lawyers, all over the board on when it will actually be put into the registry. Normally that process would take a while. With this administration, who knows.

                      Hopefully till inaguration day 2017, as long as it's not Hillary

                        Why take a chance? You said that THEY decide to prosecute. Who's to say that they don't decide to prosecute " something that small"? I've seen crazier things happen, it may be your day and they decide to make an example of you.

                          I don't even believe that it is against the law, nowhere did the ATF tell me that my class 3 has to be locked up in a safe only accessible to me. When I go to the range and set the gun down on the table it is "accessible" to everyone present. Do we then arrest everyone at the range. It sounds like a myth, and I'm not really going to chase down the research on someone else's myth. I will research the points I am trying to prove

                            When you are at the range with it YOU are there. That is different. He said if you are not at home and it is there with her, and she has access to the safe. At that point she is in possession of it, and she is not authorized to be so without you present. If you want a better idea of everything call and talk to a trust lawyer. I would recommend Jim Willi, he is great to help and will thoroughly answer every question you have. I just finished setting my trust up this morning.

                              Someone find the law that says it I have a trust and my wife is not on it. She knows the combination I guess I'm a criminal. I didn't want to bother asking for a Cleo signature, but I think trusts are now a waste of money with the new changes.
