I spoke to my NFA Trust attorney today.
Actually his Executive Order didn't "ban" trusts. The legality of the trust is written into law and cannot be changed except by Congress, so you will still be able to buy NFA firearms with a trust. I don't think, legally, he can just say "no more trusts" since it is written into law. BUT when has he ever followed the law?
What the DOJ/ATF is proposing is making the trust's "responsible party" submit a photo and fingerprints along with the trust. The ATF would then notify the CLEO in your area that you (actually your trust) owns an NFA weapon.
The ATF has been wanting this rule change for a while now and is still "drafting" the exact proposal but here is what is stands at right now:
There is also a 90 day review period for the public's input after they finalize the proposed rule change, so most people who are currently in the pipeline for a tax stamp are ***probably*** safe.
Even if I'm required to submit my fingerprints and photo with my trust, I still think it's better than the individual route since having my family members included in the trust allows them to legally possess the firearm or other restricted item without me being present.
I'm more angry about his Executive Order banning the reimportation of military weapons. This could eliminate the CMP program. I guess all those gang bangers touting Garands and M1 Carbines were a serious threat......Last edited by philcam; 08-29-2013, 07:50 PM.

This is all really stupid anyway. They should just make a NICS check mandatory for firearms and remove suppressors completely from NFA. That's just stupid that they were ever put in there in the first place.
