Assuming that the plate is run before the traffic stop and the officer delays the stop to wait for the return.

In my experience, that is not the usual procedure.

I "think" that NM has fairly open weapons laws and like Texas are a "shall issue" a CHL or whatever they call it. I "think" that in NM it is unlike Texas in that you can carry a handgun in your vehicle without the requirement to conceal it. In fact Texas does not have a concealed deadly weapon law and NM does except as mention about home and vehicle. I believe the way their law reads is that a concealed weapon (without a CHL) is against the law "Except" on your own property or in your vehicle.

I think that open carry is allowed.

I think the law also says that you can't carry on a bus, at a school or in a restaurant that sells hard liquor.

That is a lot of "thinks" but I am not so familiar with their laws. I "think" that I am correct however.

We have any NM cops on here?

I thought it was when they ran your driver's license. But I don't have a clue.

tvc hit the nail on the head. Regarding carrying with CHL or driving - too many people put too much weight on the 0.08 BAC. You can still be arrested for DWI with a BAC <0.08. The 0.08 thing just sorta makes it automatic.

Yeah but the people that I normally run into (as I don't usually make routine traffic stops) usually have felony records and I don't worry about a CHL. I just assume that everyone is armed.

Only the penalty of revocation was removed for non disclosure, you are still required to disclose.
Better clarification...if you are not asked you DO NOT have to disclose. Although professional to disclose, you DO NOT unless asked:

GC ยง411.205. REQUIREMENT TO DISPLAY LICENSE. (a) If a license holder is carrying a handgun on or about the license holder's person when a magistrate or a peace officer demands that the license holder display identification, the license holder shall display both the license holder's driver's license or identification certificate issued by the department and the license holder's handgun license.

Found something on NRA site saying basically the same. Thanks.

I guess I don't understand why you would not tell a LEO you were armed. I would think I would be better off being up front than trying to hide it. What if you are asked to step out and the LEO gets a glimpse of a handgun and you have not disclosed it? I see things getting western real quick and the possibility of me being shot does not appeal to me.
I would rather be disarmed and cuffed when I had done nothing wrong than be shot. Of course I would not be thrilled about having cuffs put on but still better than some Barney plugging me just because he got jumpy.

And how many times have you been pulled over and not asked for ID?

There is also a bill to have the CHL put on your DL from what I understand

I hate tvc. He's always so "right"...
That man has straightened me out a time or 2.
Your question was answered above so let me add that when I go out to eat, and have my handgun, I drink sweet tea. Nothing more, nothing less... I like drinking but have no problem seperating the two.

I hope like hell that they do not put my CHL info on my DL. It's no ones business if I can carry unless I want to tell them. Don't need some yahoo blurting out I'm armed (or may be...).

Kinda like this. Went to the State fair last year and was carrying. Asked the "security" guard at the gate for a supervisor. He didn't know where I would find one and wanted to know why. After a few attempts I told him I was carrying and needed to see the supervisor. He hollered out, "you have a gun??"... Then I pointed out the sign saying with a CHL it was legal but needed a supervisor. He was dumbfounded. Finally a supervisor came forward and asked what I needed and I told her I was legally carrying a weapon and wanted entry. She also blurted out, "you have a gun??"...
That's not the part of Dallas I want everyone to know I'm packing.
Anywho, she lead me in to a DPD officer and had me tell him what I needed. He checked my DL and CHL and then we talked shop about guns for a few. Nice fellow. We both said we hope neither would have to draw that day and moved on.
Concealed means I don't want anyone, other than a LEO, knowing that I'm carrying...

I carried to the fair this year but the guard new excite what to do when I showed him my CHL. Directed me to an officer and she checked my DL & CHL and I was good to go.
