OSHA vaccine mandate

    I believe they will strike down the federal mandate because of they way it is being forced through OSHA and not through congress. I think they will uphold a mandate from a state or from an employer

          Kagan

            They mandated insurance and SCOTUS allowed it

                The mandates served two main purposes:
                1. Scare tactic to get millions more vaccinated while it works through the courts.
                2. Finally stack the supreme court after they strike down the mandate!

                      Everything I've been reading from the "experts" based on the merits of the case is that osha mandate will be struck down and that cms mandate will stand.

                        Been listening to the court case this morning. It will make your head explode. The liberal Biden appointee arguing it is a nut. They are arguing on the fear and danger of the virus.

                              If you are talking about the first and major Obamacare case, that’s not correct. The SC specifically ruled that Congress has no authority under the Constitution/Interstate Commerce clause to mandate the purchase of anything. They also ruled (strangely with Kagan joining the conservatives) that Congress could not threaten states with removal of Medicaid funds they didn’t comply.

                              The loss in court was the 5-4 ruling that Article I gives Congress the authority to tax and in Obamacare it was collected through the IRS. Had it been a criminal penalty or something of that nature, it would be unconstitutional. Since it was out in as an IRS tax, that provision was allowed to stand.

                              Basically the opponents of Obamacare won every argument except the one that Congress had no authority under Article I of the Constitution to have an additional IRS tax.

                                The NC argument comes up like HIPAA.

                                There is no such thing as an enacted NC or treaty (which would be law) with it. There was a list of suggestions that no nation passed.
