    HELP ME!!!! Deed Restriction Opinions

    I've got a couple of developments under construction and have some questions about Deed Restrictions. I want them to be common sense and enforceable without being overbearing.


    Development #1- Washington County. Gated community of 2ac estate lots.
    What restrictions would you expect to help protect your property values, be a value to all homeowners, be easily enforceable, without being a pain in the butt to a homeowner?


    Development #2- Tyler County. Rural 10-25ac wooded tracts with pine and hardwoods. What restrictions would expect for this size property that guaranteed your neighbor didn't build a commercial hog farm but still allowed for an appropriate amount of farm-life living?

    Things to consider for both developments:
    Building line distance from property lines.
    Livestock allowed/not allowed
    Type of dwelling
    Size of dwelling
    Maintenance of ROW
    Fencing requirements/allowances
    ETC.

    Just a few off the top of my head would be, Pets and livestock should be kept behind a fence. No commercial livestock operation. No commercial operation of any type that can be heard from neighboring property. I don't mind if you want to make quilts but I don't want to listen to a metal fab shop in your back yard. If it's visible from the road then it needs to be tidy. I don't want to look at your trash.

      No junkyards, peacocks, (pet restrictions) nothing that is visually offensive, nasally offensive, or audibly offensive, I e dirt bikes!

        I hate to answer a question with a question but will there be an Architectural Control Committee for both developments?

        Edit: ACC for submitting home plans and and orientation of homes on property.
        Out building types and orientation on property.
        Minimum square foot of home.
        Single family dwelling or not.
        How much clearing or additional clearing can be done without compromising the integrity of wooded lots.

              Short-term rentals (AirBNB) are a hot topic for HOA/POA restrictions. Best to address it upfront. Here is an interesting document I saw on Lands Of Texas recently. (follow the link site down to the CCR Pdf doc.)

                Depends on what you are going for but I would think something along the lines of below

                1) 50 foot front set backs and 75 ft side and rear (maybe 100 depending on how lots are shaped. Minimum sq/ft depends on what you are going for but with todays costs I would say 1800 sq ft. Full masonry on front. Shop/outbuilding metal exterior or same material as residence. No mobile/manufactured housing. No swine or livestock, chickens allowed no roosters. Perimeter fence can be post/wire home and up to 1/2 acre can be privacy wood picket not to exceed 6foot in height. No STR.

                2) 50 foot front setback for residence 75 foot front setback for outbuildings 150 foot side and rear setbacks. 1800 sq ft minimum no mobile or manufactured 50% masonry. Shop/outbuilding same material as home or full metal exterior. Chickens permitted no swine or hogs with the exception of not more than two for 4-H projects. 2 additional animal units (horses, cattle,sheep,goats). Owner must maintain property and enclosure in a maner to ensure health of animals and to prevent noxious smells. Post wire perimeter fencing allowed. No STR


                Also for both no commercial business

                  80 percent masonry or brick
                  Min 1500 sq ft single family home
                  Only one residence

                            Development #2 - Hunting or No Hunting? Bow Hunting only? target shooting/discharging firearms ok?

                            I found it interesting in my neighborhood where bow hunting only is allowed by POA rules. But if someone hunts with a rifle there are no laws in place that a game warden or sheriff can enforce, except the usual about projectiles crossing property lines, state game laws, etc.
