    If you are planning a firearm purchase or transfer & have no LTC:

    Be prepared for possible delays & wait times, especially if your FFL calls into NICS vs the e-check, which may help...your covid 19 public service announcement for the day:




    Good Morning,



    As the FBIโ€™s National Instant Criminal Background Check System (NICS) Section works through the impact of the COVID-19 operationally, we are working to maintain our services. We are aware that states may be considering options to protect the health and safety of their employees, which may include a reduction in office availability or even closure to some offices.



    Should a state choose to limit their days of operation or close state offices, this could potentially impact the Brady Transfer Date (BTD) by changing the time in which an FFL can legally transfer a firearm in a delayed status. The NICS Section urges FFLs to be cognizant of the impact this may have to your day-to-day operations, and also to stress the importance of adhering to the BTD that is provided to you at the time a transaction is put into a Delay status. The Brady Act does not federally prohibit an FFL from transferring a firearm after the third business day expires, even if the NICS Section has been unable to provide a proceed response, pursuant to 18 U.S.C. ยง 922(t)(1).

          That is one reason i maintain a LTC. I get delayed every time. Mostly i get called the next day. Of course it has been 20 yrs since i once let mine expire.
          3 yrs ago i stupidly tried to buy an 870 youth at walmart for one of my grandchildren. They run everyone through nics. Got delayed, i got mad and told them to keep it, and went to academy and got his birthday present, an 870 youth.

                I bought a shotgun on my lunch break at Academy today. LTC meant no wait though. They've been really busy lately, mostly with ammo sales. Everybody is hoarding ammo again. They're limiting customers to 3 boxes. I just bought one 420 round box of .223. I figure I can trade it for some toilet paper, if things really get crazy.

                  It certainly doesn't affect me as most my biz is consignment going to dealer to dealer & do few transfers in comparison w/ most of my friends / customers having LTC.

                  The high volume dealer / brick & mortars have decisions to make when the delay goes past the BTD...do you miss a possible sale / deny a transfer, or go ahead & transfer a gun to a bad guy who could end up getting a deny. While extremely rare, I have had delays where nics either called back days after the BTD & once not at all or I missed the call. I know my guys personally and the delays are always with the same who refuse to get their ltc or file for a upin.

                    It riles me when a dealer runs you even if you have a ltc. A couple of pawn shops near me do also, told me they had to, it was the law. I refused to buy from them, and passed a couple decent deals.

                          FFL's have discretion & the right to still run a nics check on a lic holder but NOT required..I personally don't get it other than paranoia of mitigating risk or thinking it's a fake lic. Getting your ltc is no different than the background check to approving a nfa item.

                          So, the dealer either doesn't trust your 411 or thinks you committed a felony since receiving or is so worried about getting sued he can't sleep at night without a check?? Again, it may not be fair as I personally know who comes into my castle but personally wouldn't patronize any dealer that did a check either.

                            Does this mean a criminal, knowing the NICS is down or very slow, could go in and fill out the 4473(even lying there)and after a 3 day wait, go get his/her firearm?

                            Of course, he would just add fuel to the fire, but hey, he/she may have dastardly deeds schemed up.

                              A felon should get a DENY. If he did luck into a delay, then maybe. Should get denied before 3 days. They should prosecute if they try.
