              Nope. It is not legal. Therefore it is a crime. :-) I may have been sick the day they taught law in law school, but fairly certain utilization of a phone for listed purpose is not a crime.

                  Nope, completely wrong on your web theory there spiddy. But I'm at least smart enough to limit what I say about an employee in an open forum. I had a question, it's been resolved without the need anyway. Thank you for the replies.

                          Does he have sick time that he can use? If so why do you give it to him then get upset when they take it. Mental health (deer stand) days are needed for people to perform at their best sometimes.

                          Do you have a policy for no more than # unplanned occurrences in a 90 day time frame. I used to work where the policy was 3 occurrences in 90 days. An occurrence was non-consecutive days. For example Mon&Tues was 1 but M&W the same week was 2.

                            That's like saying you can rob a bank but if you get caught you would get in trouble.

                            If you get fined by the EEOC then you can't just fire anyone for any reason.
