Holy cow man! I'm glad she's ok, and that nobody was seriously hurt.
Now regarding insurance and her rates... I've worked for 2 major auto insurance companies. Both view falling asleep while driving similar to a DWI. Fortunately for you, the trooper didn't write a ticket. Hopefully that remains the case. That way, the falling asleep behind the wheel never gets documented in a way that will make her nearly uninsurable. I don't know if this is true for all auto insurance companies, so maybe I'm not 100% correct, but the reason I've been told, by both companies I've worked for, that this is a big deal is because is shows a willingness to drive when you aren't fully in control, similar to DWI.
Long story short, don't mention the "why" to your insurance company. Hopefully she learned a HUGE lesson and above all, I'm glad she's ok.

I understand the Investigating Officer writes his report and the DA decides whether or not to issue a citation based on the report. Had a hydroplane accident about 10 years ago which totaled my company car, and the Investigating Officer, whom is famous in Jasper Co. for writing tickets, did not issue one at the time of the accident. However, I received one in the mail about 3 days later and the reason was for "Failure to Control Speed". Took it to the JP and he said pay the fine and I will give you 60 days deferred adjudication.

I was driving home on the road I live on in the rain one night. Literally 1/2 mile from my house. Hydroplaned after a curve and tapped a tree. Was only going 30-35mph but my tires were in bad shape. Just enough to pop the radiator and mess my ankle up pretty good (didn't break it thank god). Called a tow truck driver and a cop came along shortly after. As I'm standing there holding my ankle in pain the cop writes me a ticket for speeding. I told him I wasn't speeding and he said he didn't care. I just did some serious damage to my car, I have to pay for a tow truck, my ankle is in bad shape, and now I have to pay for a bogus ticket. I just wadded up the ticket and through it on the ground in front of him. He looked like he was thinking about doing something then just walked off. I don't remember if I ever paid it or not..Last edited by Deers & Beers; 10-31-2017, 11:39 AM.
