    DPS Accident Question

    My daughter fell aslleep and rolled her car yesterday. Thankfully she is ok. I understand when the DPS works an accident that they will always issue a ticket. The officer came and checked on us in the ER after the accident yesterday but did not right a ticket. Does that mean we will not receive one or can we expect a citation in the mail after the investigation is complete?

    They don't always write one. It's officers discretion.

      This is true. Unfortunately, I've been involved in two accidents. One was my fault, one was not. I was not issued a ticket when I was at fault, and the other driver who was at fault in the more recent wreck was not issued a ticket on site either. I guess it could have been mailed later, but I'd doubt it.

        This^. If there was no other vehicle involved that may be why he is not giving a ticket. Most of the time the ticket determines who is at fault.

          That is awesome! Thanks. My insurance is high enough with a teen driver and I hope she doesn't get one for her sake as well. I'm just glad she's alright. Lucky to roll a vehicle at highway speed and walk away with only seatbelt bruises and a scratch.

            It will still go up when you file the claim unless that car was paid for and you wont be filing one.

            Glad she is ok

              Most of the time now days the ticket is mailed after the complete accident investigation is complete. Just because you didn't get one at the time of the incident doesn't mean you wont get one.

                If she does get a ticket, just go to the Judge and asked to have it deferred (6 month probation-community service-and defensive driving) then the ticket will go away and she gets extra training.

                My sons (17 year old) insurance rate dropped after a wreck with this

                  In the mid 90s I ran a stop sign and hit a van. When the officer showed up, I explained that I had no idea there was a stop sign there as my view was obstructed, I was not issued a ticket.

                    $2000 car with liability only. I learned my lesson on buying a nice car for the middle daughter. Lol

                      I typically don’t issue citations when the wreck only involves one vehicle and no property damage. I figure the loss of a vehicle and personal injury is enough of a lesson. No need to rub salt in the wound.

                        My brother hit a cow at night, left the road flew over a fence and hit a tree. Had broken ribs and bad cut on his head. DPS came to his house the next day and asked if he had his seat belt on, he said he couldn't remember. They wrote him a ticket for not wearing a seat belt.

                            I don’t write tickets ar wrecks unless it’s for a DL infraction or no insurance. I’m not an accident investigator so I won’t write tickets that could determine fault. If I did, I could wind up in court and be raked over the coals by an attorney for the insurance company. No thanks
