Regardless of legality you are going to be in a world of suck if you use deadly force against someone not posing a reasonable threat of bodily harm to you.
I'm curious if you've given the additional information to the agency, beyond reporting the break in? Solvability factors are used to determine if there are leads and followup needed from the details in the initial report. It helps to assign those cases that have leads and not those that don't, wasting valuable time. If you have, and it seems you do, additional information, you should contact the agency again and turn this over to them asap.
Oh, and a property crime isn't going to bump a more serious crimes down, so don't get frustrated with the speed of followup investigations.
I highly recommend that you do not take deadly force against a car burglar. Regardless of the law, you won't win since there are more prudent ways to "apprehend" the actor(s).

It's not a property crime, it's credit card fraud, which is a felony in texas.

as for the letter they sent me. I'm not upset about the speed of it. I'm upset that there will be no follow up at all.

You can leave off Waffle House and Valero and my answer is still "yes". People shouldn't steal other people's anything....ever. But hell, I think being stupid should be a capital offense. It's not....lucky for you.
Theft is not a crime punishable by death, and I would think most Christians would look down on killing someone to protect "stuff". If I felt my life may be in danger, yes deadly force for sure. But, I have insurance to cover things that are stolen. Yes, it sucks (I just went through this), but I would not kill someone over it.
I believe the Bible mentions, if someone steals your cloak, give them also your tunic. It doesn't mention killing them over it.

It wouldn't make a difference. I was recently robbed anyway. Kind of sucks, but still not worth shooting anyone over. Sometimes people make horrible choices in life. Not worth dying over.
If a person is in your house illegally how in the world do you know what he is or is not carrying and how do you know what he is going to do next if confronted. What are you going to do, go out the back door, wait until he pulls a weapon, pee in your pants or take matters into your own hands? Yes if he is walking out the front door with a TV and you holler at him and he drops the TV and takes off, then YES you probably should not drop the hammer on him, but if he drops the TV and reaches into his pants or whatever what are you going to do? Too me way to many variables, but I stick with my original post, if he is in my house I consider him a threat to me and my wife. HE HAS NO RIGHT TO BE IN MY HOUSE, armed or unarmed!, especially if he reacts in a manner of not hauling butt out of my house when I fire a warning shot or yelling at him.

I have had to pull my pistol on two people in 17 years of carry. Luckily I did not have to shoot either time. Just pulling it out was enough to dissolve the situation. I like to think if someone was stealing my TV and was already leaving I would try to stop them but not with deadly force. Now if they are in my house and attempt to attack me, or my family, they are done. If they just run away, i'm ok with that too.
In all actuality, if you feel you are being treated unfairly, contact the investigators supervisor and voice your concerns. Remember, PROVING someone did something is a heck of a lot different than believing they did it and even "knowing" they did it. There may be more to the case that you do not see.

Call and speak to a supervisor. Let them know what you know. Demand some followup be done. If you get no satisfaction there, go to the Lt... if still nothing, assistant chief, then chief... everybody has a boss.

"Investigators, are always snowed in, over worked, and usually carry case loads that are insane. At one time last month I had over 85 pending cases assigned to me. People should understand and have some patience (especially in property crimes) because that they are not the only person that is assigned to a particular investigator." I'm quoting me, just now.
To the OP: seriously contact the investigator's boss if you cannot get answers from him. Voice your concerns and they should get back with you. Just like with my caseload when I am snowed in and trying to prioritize, the squeaky wheel gets the grease.
