    Yes.

A lot of illegals or LOW Lifes buy a policy and cancel it the next day and show the card, when in reality they are not covered

Obviously you have no clue how this works. If the police would have issued a citation at the scene, the insurance would have magically appeared on the at fault car and the victim's car would be paid for. Therefore the police are responsible for running into the back of a car and for not providing insurance.

        Simple.......

They totaled her car, the other driver provided insurance and all was good. She found out today that the guy had provided an insurance card of insurance that he did not even pay the first months payment on so it was delinquent/cancelled. She talked to the police today and asked if there was anything they could do, she was told no because he provided "proof of insurance" at the scene.

Is this seriously legit, so someone can drive around with cancelled insurance and basically get off free because they can provide an insurance card at the scene even though it is not valid?
the victim can go to the local court and file the charges for no insurance,,, take what ever evidence they have

They can still issue a citation for it.

I'm going through the same thing right now. Lady from foreign country ran a stop sign and hit company truck. Her insurance denied the claim because they can;t get a hold of her for a statement. I filed a claim with my insurance company. My insurance company will pay the claim (minus deductible) and will attempt to collect from her and/or her insurance company. Once my insurance company collects I will get my deductible back. May take several years but I will eventually be reimbursed.
