    Last time I got pulled over the DPS officer didn't even want my insurance. Apparently he had already run the plate and knew I had insurance

    Girl needs to take the other driver to court and tack legal fees on top of what money she is out (if you can do that?)

      The law has told me when stopped that it will come over thier computer if your insurance is valid or not. I was pulled over awhile back and had an expired card in my truck. The wife had given me the new renewal card but was on my desk and not in my truck. Officer looked at it and said sir it is expired. I told him I had valid insurance but have just failed to put new card in truck. He said it's ok, when I run you in the system it will tell me. Anyway came back and said you are good to go, slow down and a warning for today.

        Yes this is correct. A card is not needed to tell if you have valid insurance. Spillman will tell you everything you need to know about the status when you run the plate.

          Then they should have caught it while on the scene right? Or did the officer more than likely look at his card and not run him in the computer?

            No need, her insurance company will do that for her. They wont pay for the new car out of the kindness of their hearts. Same thing happened to me and USAA got every penny back they paid me out to include my doctors bills.

              They probably didn't run it through their computer.

              She should call any liability lawyer, they'll take the case pro-bono and it won't cost her a thing but the time to talk to them.

              Sucks she only had the car 4 hours, and she's only 19 having to learn about all of this the hard way. Incredible that he hit her hard enough to total the car and she didn't get hurt too! I have heard of many people who were seriously injured or killed in similar careless acts.

                Yeah but if she put $1000 down on the car and all they did was pay it off she is out the $1000 down payment plus the $250 uninsured motorist deductible. She could file suit for that, probably wouldn't get anything but a judgement but it's better than nothing.

                  The 1K shouldn't matter unless she overpaid for the car. The insurance company will replace the value of the vehicle which the 1k is part of. Now the 250 yes she will eat that and could sue but man, who would want to go through all that fun for only 250 bucks.

                    When I lived in North Carolina in the early 70's if you did not keep insurance in force on your car they came around and confiscated your license plates. If you failed to keep up with the monthly payments it was reported to the police. This was before cell phones and computers. Just shows how far Texas is behind in protecting the citizens. Surely we have some self righteous politician that will take up this cause .... in an election year.

                      The OP said the insurance company was paying off the car. Didn't say anything about the down payment.

                            Happened to my daughter. Lowlife thug gave an insurance card that wasn't valid. Police on scene of the wreck "verified" it on scene, BS, it was never valid I found out the next day when I called the insurance company. We were s.o.l. with them. Had to file on my uninsured motorist. I'm out $250 deductible and police basically told me to pound sand about them doing anything about him. I will not confirm or deny that he may or may not have had to buy several complete sets of new tires shortly after that.

                              So I got a better rundown from her this morning, there was no money put down on the car so that is why they are getting just payoff for the car. Yes she is going to be out the $250 for the under/uninsured motorist. She is in a lot better mood this morning about it. I think the story got a little skewed yesterday because of her finding out he didn't have insurance and she was unsure of what this was about to turn into.

                                This is pretty much the situation she is in. Not out anything other than the uninsured claim and more time to go back through all of it.

                                It's sad that there's not much that can happen now in regards the the POS that knew he did not have insurance and gave an invalid card. I remember my grandma getting hit on a County Road by some dude and he didn't have insurance, I watched them put him in cuffs and haul him off to the pokey.
