    Question about Criminal Trespass?

    If anyone with knowledge of the usual (if that is the correct term) punishment for Criminal Trespass is, I would appreciate your input.

    tx penal code pc 30.05 .wide open question. punishment depends on lots of factors, set limits are listed in the tx penal code listed above

        Thanks, I kind of figured it wouldn't cut and dried. I guess I'll have wait and see how it comes out.

        He is suppose to go before the court on the 23rd. Will they impose a penalty then or is it just the beginning.

        Excuse my lack of knowledge about legal things. I've been a good boy since about 5 years after Nam and laws change.

                    A lot depends on the county. If a person pleads guilty in front of a judge on a misdemeanor then the judge might render judgment at that moment. The law is the same for all counties but different DAs or judges might give punishments differently within that law.

                    In my county if you plead guilty, the judge will ask if you want to make a statement and then give your punishment.

                      B misdemeanor is up to 180 days in jail and/or up to a $2,000 fine. A misdemeanor is up to a year and/or up to $4,000 fine.

                      A judge could legally give a $1 fine and case closed. He could give any fine up to the maximum OR anywhere from one day in jail up to the maximum OR some kind of combination of the two. Jail time can then be probated over time meaning if you successfully served out probation, jail time need not be served.

                      The length of probation does not necessarily reflect the sentence. For example a judge can sentence a person to 30 days in jail, probated over a year. If anytime during that year the person's probation is revoked, he does not serve out the year in jail but only the original sentence of 30 days.

                        I knew the JP had quite a bid of leeway in sentencing from talks with a couple of Game Warden friends of mine. I just wasn't sure what parameters were in this case.

                        I know he made video confession. So I guess we'll see where it goes from here.

                          Couple of no-minds here in Guadalupe county cut a fence, shot a fallow buck and a wt buck, cut off the heads and dumped the carcasses. GW arrived at the residence and found them boiling the heads. According to the paper, it was a felony. Haven't heard of any disposition at this point.

                            It isn't like this stuff is new. It's been around as long as I can remember but it seems (at least) to be getting worse. It never fails to amaze me.

                            It will take someone smarter than me (and that won't be hard) or someone that has dealt with this a lot do explain why someone would do that. I just don't get why it's worth it.

                              Does he have an attorney as of yet? Here in Tarrant, it sometimes, most times probation, but I wouldn't represent myself.
