    Violation of Equal Employment Act?

    Not trying to start trouble, just seeing if any experts will chime in.

    Suppose a person (not me) goes into a business to follow up after inquiring over the phone first about employment. The manager lets you inside, you shake hands and then he disappears and says he'll go into the office to get an application. Don't know if the fact his race is different than yours has any relation to this issue or not. Just mentioning this as info. You wait a while, then he appears at a desk and acts like he's having printer issues. You make small talk as he gets one paper to partially print, but says the printer has crapped out. He then asks for an email address to send you the application and says I'm sending it to you. But you never receive anything.

    I know there are a number of added statutes to the Equal Employment Act. One even mentions protection for those over 40.

    The above loose account sure sounds like denial of even being given a fair chance to apply.

              Maybe the printer just crapped out and the guy forgot to follow up with the email. Your friend should go back and try again.

                Certainly not a violation at this point...applicant can't even verify the reach out was even attempted.

                Lost said email, typo on the address, etc...a follow up would help confirm any suspicions & should have been acted on before anyone crying wolf??

                    He didn't cry wolf. He didn't put any names out there. Maybe he didn't know what to do so he is asking. He obviously needs advice. I believe he has gotten what he asked for.

                      Lighten up...my comment is based on the OP's comments & it reads like accusations, don't you think?? If the applicant gets blown off after following up, then they have some ammo to at least state the following:

                        I don't think he's trying to cop out of getting the individual an application. Why would he not give him an application? An application for employment isn't new hire paperwork. If he didn't want to hire the individual, he just wouldn't call them back after he received the application. Jmo

                            Friend needs to follow up. If all this continues to happen, it all needs to be well documented. Dates, times, actions. If he can, he should try to meet some of the other employees. Do they have anyone over 40 working there? If they do, this would hurt his case.
                            Maybe he just made a really bad first impression?

                              As small business owner this is why I use an online company. I don't take any paper applications, too easy to misplace or lose one. I get an email when they apply, I send them preemployment testing, they fail and I don't waste my time and I also don't know age, sex, race, or anything about them. It's all very structured and fair, removes any chance of accusation.
