    If you had it surveyed when you purchased and don't mind spending a few bucks, call the surveyor and ask for an update.

      Shortly after buying property my dad went back and put in a pin in cement next to the surveyors pin.

        You need to get it fixed or they will eventually be able to claim the captured property by adverse possession.

            Talk to neighbor first. It's possible that whoever he had build the gate/fence moved it over a little to make the job easier for one reason or another. He may have no idea that it was moved. Regardless, you will want it updated by the surveyor. Otherwise it will need to be addressed when either of you sell. But by then you could face adverse possession issues.

              I wouldn't sweat adverse possession. First, you would have to prove hostile intent, after 15 years they could file for title. After 25 years, they can claim it.

              Simply, talk to your neighbor. It may have been the fence builder that is at fault.

                I would think the first question would be : What kind of relationship do you currently have with your neigbor? If the answer is "good" then you should be OK. If the answer is bad, you're fixing to insure it stays that way.
