    Illegal to remove Survey Pin?

    When I bought my Ranch I Rode the entire place taking pictures and such. I made a point to take pictures of all Survey Pins because we all know after time they can be hard to locate.

    I had one right at the road that goes by my place and I remember on it just like all the rest I placed rocks around it and added some purple paint just for GeeWiz.

    About two years ago my neighbor put a fence in and I really didn't notice BUT it comes into my side of the pin. About a foot to meet with a gate that crossed the road.

    BUT you can’t really tell because the Pin and all the rocks are gone. I know the location of where it was with the picture I took.

    I can't say that he removed it or for that matter whom might of removed it but isn't that illegal? Can I get it replaced?

    No clue but you have to ask your self is a foot of dirt worth the trouble?

      Not really and I have 700 yards of fence to boot. But why remove it. Just ask to match the fence to the gate and leave it alone.

          It would be illegal if it was a federal property pin, I don't think it applies to personal property. The problem will come if one of you decide to sell, then the fence will probably have to be moved to satisfy the inspection.

            Good neighbor would talk to you before removing survey pins. I always drive another rod level to ground that is an inch or so away from original.

              You can have it resurveyed. then if it is on your side you can have him move his fence and gate to the correct place.

                It can be. Once a property starts being sold for retail use, in many instances, it is sold by the square foot.

                  It is illegal but can be resolved by having a registered land surveyor come out to replace the pin per the record plat

                    Wouldn't the original meets and bounds plat be on file at a courthouse or title office?

                      Yes it would, but since he is only talking about a foot IMO you need to have exact measurements incase you have to go to court over it all.

                        I'm a land surveyor and it is very illegal .. As recomended go to court house and get your land platt and have a surveyor come out .

                              Have it surveyed. Have new pins placed. Then talk to neighbor if your concern was true.
