    Neighbors Tree Issue

    Not sure how to handle this, my next door neighbor has a large dead tree that could fall on my house and my ac, they don't speak English.

    Got my mowman to let them know about the tree and the possible damage, he was on the phone with the owner of the house when he told me she wanted me to pay for having the tree cut down.

    If the tree falls and caves in my roof the city will probably tell me my house is inhabitable and force me to leave until I can have it fixed, or the ac gets crushed and I have no cool house in this heat.

    Tree is about 10' on their property and around 50' tall, my house is close to the fence on that side.

    I guess one solution is for me to pay to have "her" tree removed.

    Any ideas?

      No problem. Pay someone to come drop the tree in their yard. Period. No clean up needed thank you. Your welcome neighbor

        Call the city property standard department and let them know about the tree.

          For starters, I would send the owner a certified letter explaining that she has been informed of the dead tree on her property and is now liable for the future damage the tree may cause.

            any limbs that are hanging over your property line are fair game. the tree is her responsibility. any trimmers that are hired by either one of you should be bonded/insured.

              deer99hunter that sounds like a good idea, stickerpatch59 nothing hanging over, the limbs are right at the fence line but if the tree falls about 30' or so will be on my property and house. BigThicketBoy not sure if a judgement will help lol.

                Document your concerns with a certified letter to them and go from there.

                    Notify the city or county. No matter what you do it will do any good.let the professionals do there jobs

                      #1 Call your ins agent and ask what will happen when his UN-Insured tree hits your house. There is something called {falling objects} they should cover.

                      #2 Would be a registered, letter in their language that has a notary stamp.

                      #3 Would be pay to have it felled only. Leave clean up to theme.

                      I really think you are covered by your ins company but it may have a $3000.00 deductable and paying a grand to have it felled would be the cheepest route, and I would really get a kick out of leaving a 50 foot tree in their yard.....

                        And heck yes on the bonded insured tree cutters. I made mine bring his policy and I called his ins company and made darn sure it was in effect.

                        They dropped a 40 foot tree 6 feet from our back door..

                          IMO, Its their tree in their yard and there is no issue now.......just a concern. I would be happy if they would split the cost which they may consider if you somehow explain to them what BTBoy said "pay now or pay later". If they insist on you paying for it all then get their consent in writing (make sure it doesn't require you to clean the mess) and most importantly please take pics of the pile for us to see once done!

                            This. I have a rent house and the property next door had a large dead tree on it that if it fell could have hit my house and injured someone that was walking by. I let the city code enforcement know and they gave them 10 days to take the tree down or the city would do it for a considerable fee. It was down in a week.

                              Thanks for the info, #3 sad thing they would never clean up the debris, don't make me post pictures of their back yard and their front yard! #3 it will be..
