    Sounds like she already gave you permission to cut it down. Get it in writing that she authorized you to cut it so that it is not a danger to your property. Paying somebody to cut it to 9.5 feet will be cheaper than your deductible and a lawsuit after the fact if it does fall. If its dead. It ain't gonna grow into a problem later.

      This is spooky. Was just walking down the middle of the street and my neighbors tree flung a big limb. It landed 12 feet to my right and was big enough to at least put me in the hospital.
      Freaking spooky.

        That's how Greg Abbott ended up in a wheelchair, a falling limb.

        Here is a picture of a tree that was alive that fell through a house I do property management for. This tree showed no signs of bad health before it fell.
