Sounds like she already gave you permission to cut it down. Get it in writing that she authorized you to cut it so that it is not a danger to your property. Paying somebody to cut it to 9.5 feet will be cheaper than your deductible and a lawsuit after the fact if it does fall. If its dead. It ain't gonna grow into a problem later.
