Looks like a Yaupon that got "leggy" from not getting enough sunlight. Leaves dont look quite right for a creepy moytle.

Looks like Texas persimmon. If so, the leaves will be a little thicker than most trees and most usually have little green bumps in the leaves as well. Nice trees
