Moving violations are assessed points. I should have edited my other post to say that some violations don't have to be assessed points in order to have a surcharge applied.

I had to quit reading, I have never gotten a ticket I didn't deserve, I have gotten some I didn't totally agree with, But I was wrong, I have gotten out of many simply by being polite and acknowledging I was wrong. I do not agree with the surcharges, But if I have to pay them one day it will be my fault. Have a nice day. Cmon October

If I'm not mistaken there's also one for habitual offender (i.e. "points surcharge")

Can't do that. Two entities involved. One dependent on the other. If issued citation for No DL by "Wherever Police Department" you have to be found guilty of the offense by Wherever PD before the surcharge violation applies. Wherever PD sends notification AFTER judgement to DPS- who then notifies you of surcharges.

I was talking about the points accumulating, not the surcharges.

My point exactly. How can you fine me twice. Call it what you, but funds required for a violation is a FINE.

Bottom line is we're being charged twice for the same violation.

Surcharges only apply on moving tickets after you have accumulated 6 points

Shouldn't they be informed of the surcharge at the time of paying the initial fine? I think they should. Maybe even have them sign something saying they were made aware of it so there's no dispute later on, but make sure they are informed of it as soon as conviction is done.

I know several incidents where the people involved in the accidents did NOT have valid insurance and they were NOT taking a ride..and their car was not towed. In two of them, they couldnt provide a valid DL either.
Have no idea if the issue is the language barrier and the people just didnt understand that they were supposed to get in the back of the police car or what.
                        Thats the norm around here.
You are referring to Harris County law ... the remainder of the State enforces laws as they are written.

Actually... one of the incidents was in Montgomery.. another one in Brazos, another one near Caldwell (guessing caldwell county)

Heck aren't most surcharges for 3 years? Kinda like 4 fines if you ask me. Also, for those of you that are paying a surcharge. Take a look at were your surcharge bill comes from. Certainly not Texas. My wife has one and it says Texas dps, then new York?
