Man, your description led me one way, then I saw the picture and did not see the issue. It is not my cup of tea, but It really does not look that bad. In fact I would say it looks better than just a basic lawn with 2 dollar shrubs in a 2 ft flower bed. Think there are way worse things to complain about in this world than this. But at the same time, the rules say what they say, so you are in the right. Doubt you will win this.

I used to help with the HOA, for several years....problem is some of these people get on the board to make themselves feel important and do not care that people that moved into the neighborhood and had the covenants given to them beforehand, knew that moving in there were rules to be followed. What will **** someone off more than anything is to do the right thing and be denied for this or for that by the ARC and then see crap like this happen where someone does what they want, specifically barred by the deed restrictions they had to agree to to move into the home, then to have it approved, be it by the hoa or developer...developer only makes it worse...it's a moving freaking target and not on a level playing field for everyone....means the paper that the deed restrictions are written on are worthless....
I had the moron that lives behind me, put river rocks between the sidewalk and curb all along his yard and 5 feet into mine...now the bleepin rocks are all over the place, out in the road, all over the sidewalk, all around the mailbox, in my yard....it's like a war zone when I mow the grass.....if I find his rocks on my property, well, lets just say he gets to find him in his yard like I find them in mine....he has been asked on many occasions to deal with the rocks but chooses not to so, he gets to sling them with his push mower....
heaven forbid you live in a regular newish neighborhood and have someone lose their job and the house get foreclosed on....eventually the house gets leased or goes section 8 and there goes the neighborhood....once you get renters or section 8 in the hood, hoa's are useless....

Mitch, did you not read all of this? This is at least the 3rd time I've explained this, but since you missed it ... my beef is not with the yard itself, even though I think it's butt ugly ... my beef is with the HOA. I posted a screen shot, from our deed restrictions, that clearly prohibit this type of yard. The HOA has done nothing about it, but slap them on the wrist. When they were threatened with legal action, the owners went directly to the developer, and got the HOA's decision overturned.
JJ, I'm not real sure how our HOA is structured. We send our dues ($830/yr) to some office up in Spring. There's a whole office of people up there and I think they "serve" a bunch of neighborhoods. I don't know if any residents even have anything to do with it, except paying dues.
