A new level of POed at the HOA!

Just when I thought my HOA was getting a handle on things, they fall flat on their face!

Some of you remember my rock yard neighbors? The ones that covered their entire front yard with crushed granite and flagstone! The ones that got letters, then certified letters, then the "incident" turned over to the HOA's attorney!

Now they're the ones that appealed the HOA's decision to the developer and got APPROVAL to leave that ugly *** yard the way it is!

I just got off the phone with the HOA representative (I'm not sure what her "official" title is) and told her that I feel like the HOA doesn't have a leg to stand on, regardless of what I do at my house. I told her that I would be wiping my butt with the deed restrictions as soon as I got home!

If you've spent any time down on the coast, there are multi million dollar homes that have the all rock front yards. If they are kept up it looks nice...

You're a tougher man than I am. I always buy the good toilet paper.

fugly yard, theres one in my neighborhood too, but i think HOA are a POS and have no right to tell you what you can do with your yard, roof, house, cars in the driveway etc.

I agree, but the problem is when you sign the HOA agreement when you move in, you are giving them some right to tell you what you can and cannot do. Believe me I'm not defending them, mine is terrible too. We have speed bumps the size of small boulders.

If you think they are powerless... miss a dues payment.
They'll own your house for the cost of your dues.
                  .

                    1. I don't live on the coast.
                    2. I don't live in a multi million dollar home.
                    3. And most importantly of all, the deed restrictions clearly state this is not acceptable.

Looks like you have a leg to stand on. 15 b seems plenty clear.

                            Kevin,
Do you live inside the city limits? If so, you may have some recourse via the City and their Code Enforcement department.

In Arlington, the Code Enforcement department will write up home owners for deed restriction violations. In our neighborhood, there is a restriction on portable buildings in the back yard. Ask my neighbor down the street who paid $5800 for one that he ended up selling for $2500 after the City paid a visit and threatened a fine. (ouch) He tried to get a variance but failed.

As for me, the City wrote a letter to me about my discarded appliance on the back porch, said I needed to remove it. I called them to let them know it wasn't an appliance, it was a smoker. A gal from the Code Enforcement department paid a visit to check it out and agreed it was no longer an appliance, took some pictures to show her brother who she said was the King of Ribs.

I told her the King lived in Dallas, not Houston.

Get a lawyer, take them to court.
