    Trust and NFA questions

    If a single individual is listed as the settlor/trustee on trust and there are additional limited trustees listed who all is required to be finger printed, etc when purchasing a NFA item

    Say I am the settlor/ trustee and my wife and adult son are listed as limited trustees. Do we all have to go in and be finger printed when purchasing a suppressor?


    What if you add another trustee after you have items assigned to the trust? Do they need to be finger printed at time they are added?

    I would "google" it as I'm sure someone would suggest but not really sure how to word it

    I already have the trust drawn up just all new to me and want to do things the right way the first time

    Everyone on trust gets printed and photos regardless of position.

    They don’t need to be printed or photos until you add a new item to the trust.

        Did you use a fill in the blanks trust? Or go through a trust lawyer?

          My understanding per my trust lawyer is limited trustees do not have to provide prints/photos because they cannot change disposition of items within the trust.

          They can posses but not add or sell items from the trust.

            I would ask whoever drew up your trust. I wouldn't trust some spewed information on the internet for something like this. It may depend on wording of your trust.

            Who did the trust for you?

              I agree it all depends on the wording. I had Sean Cody do mine so know exactly how mine works. Without knowing the language it would be a safe assumption that all need finger printing.

                I have had this same question; if not exact. I have not tried yet, but have called and emailed the gun shop. My brother set up the trust and I am on it. He is the only one that has purchased a suppressor on this trust. My question to the shop was similar to what the OP posted; their response was to bring in the trust, they take my prints, and I purchase the suppressor.

                Hope that is how this ends up working....

                    The wording will depend if they can buy or sell off the trust, but the ATF requirements are same regardless. Anyone on the trust at the time of submitting will have to include pics and prints. Regardless of their status.

                    Now this is the same as all legal advice. Don’t trust some idiot off the internet. Refer to a knowledgeable lawyer to verify such as Sean or Jim Willi.

                      It depends on the wording of your trust, and if you don't know or can't suss it out from your trust, you should ask the attorney that put it together for you.
                      I can add and remove trustees at will, so when I want to add a new item to the trust, I remove all other trustees with the stroke of a pen before I do it. I am free to add them back if and when I wish to.
                      I also maintain the only copies of the original paperwork that adds and removes trustees.

                        Technically notarization is required to validate the addition to the trust regardless of how it’s worded. You are correct that you can add and remove as you please, which would do away with the requirement for them to send pics and prints if they aren’t currently on the trust.

                            You are correct, but this is a minor detail akin to technically I have to get out of my chair and walk to the printer too. My EA is a notary, so I can stop by her desk on the way back to mine.
