    Form 1 Disapproved

    Well this sucks. My form 1 came back as disapproved for "inaccurate mfg. info provided."

    I put FMI instead of Spikes Tactical LLC as the lower is stripped and I am the manufacturer of the SBR. Now they're telling me I have to resubmit and can't change my current Form 1. In my opinion this is their mistake. With my luck I'd resubmit with Spikes listed as the manufacturer and it would get sent back for the same reason.

    Anybody ever able to change an e-filed Form 1?

    These are the instructions that I followed. It's on the internet so it's gotta be true!

    If you are creating the firearm yourself, such as a silencer or a short barreled rifle (when finishing a receiver that is not yet a firearm), there is no original manufacturer. Because of the large number of makers (which includes filings by trusts), we do not issue a specific code to each maker. Instead, we use a generic code of FMI to denote a Form 1 registration. Thus, when submitting an eForm 1 where there is no original manufacturer, on the line item screen, a window for the entry of manufacturer is opened after clicking the Add Firearm button. At this point, the applicant should click the “By Manufacturer Code’ button and enter FMI as the manufacturer code and click Verify. The applicant will then select the United States as the country of manufacture and proceed to the description screen. Please note that ‘FORM 1 REGISTRATION’ will appear as the name of the maker on the PDF of the eForm 1. Again, the applicant is the maker and registrant for purposes of the NFA and must mark the firearm.

      Yeah there is was an email at the bottom of mine on the rejected copy. I corrected it and resubmitted and had an approval in less than 48 hours. Mine was for the same reason

        So resubmits typically take very little time I hope?

          Same thing happened with mine on a spikes as well. They are very very picky about the manufacturer and the model and serial numbers being exact. They got me on the prefix on the model number. Also do not use a PO box for address

            FMI is for 80% receivers right? Ive filed mine under the manufacture of the lower.

              This, one of mine got kicked for the same reason, emailed the contact on the rejected copy, resubmitted and sent the control number to him. Had the approval the next day.

                I just got the same disapproval today. What BS. All my info was correct. I am going to try calling......wonder how many hrs that will take

                      It says "would include" not only 80% lowers. Then goes on to say "If you are creating the firearm yourself, such as a silencer or a short barreled rifle (when finishing a receiver that is not yet a firearm), there is no original manufacturer."

                      So, IMO, I am the manufacturer. I am taking a stripped receiver and building a gun, not "modifying an existing firearm" into an SBR.

                        You did not manufacturer a firearm. The lower is already a firearm.

                        You are assembling a SBR from a firearm(lower).

                        The lower is considered a firearm by the ATF.

                            No. YOU made the mistake. You know and said that spikes built that lower. They are the manufacturer that you put down. It's been that way since day 1. BUT yes they should let you email and correct it with an approval fairly quick. No big deal. Lesson learned.

                              Mine was kicked for putting multical, re-submitted and approved on the same day. Make sure after you resubmit to email the person who rejected it with your new control number.
