    NFA trust question

I hear they are changing the law in January. Do you have to setup your trust by January to be grandfathered in or do you have to use your trust to purchase a supressor by january in order to use the trust?

I am just looking into setting up a trust.

    Thanks.

I think the law/bill whatever it's called was tabled until at least 2015 so it won't go into effect in Jan of '15.

Thats what I am asking. Can I still setup and purchase a supressor under a NFA trust and if I do setup the trust can I purchase supressors next year or would I have to buy what I want before January.

It has been tabled until 2015 but no decision as to whether it will go into effect has been made.

You can purchase the suppressors whenever. It's just a gamble at to whether the decision will be made at what point in 2015.

Will current trust supressors be grandfathered in or will they need to be re-registered to an individual?

My understanding is it will only affect purchases after (if) it goes I to effect.

They will still be registered to the trust but certain people in the trust will have to be finger printed, bg checked, photographed, etc.

If this goes into effect, what advantages will there be to having an NFA trust then?

                  Email from Sean Cody:

                  Good Morning,

Okay, so a while back the ATF said that a trust is NOT A Person.

BUT . . . 922 says that a "Person" may not make a Machine gun.

Then several trusts submitted form 1's to make Machine guns.

At least one form 1 was approved.

Then the ATF calls this guy and says . . hey, a trust is not a person . . unless we want the trust to be a person . . but the trust isn't a person because we say its not . . unless you re talking about Machine guns . .then a trust is a person . .you following this?

so, you have to listen to this. It shows that the ATF really is making their interpretation of the laws up as they go along, to suit the outcome that they are politically inclined to obtain. Its not a nation of laws, but a nation ruled by government agencies that make it up as they go along.

If you think about this . . it should scare the hell out of you.

Yes I have been following this closely. If I had sent in a form 1 for a MG and recieved a stamp saying I could build it, I would have built it and Sean and I would be going to court very soon... I would not have handed back over the stamp and he himself advised the guuy not to. He's my lawyer and the person who made my trust.

advantages will still be ownership/possession of many different people to the same NFA item and passing the NFA item down the line if you die. As an individual only you can own, possess and be in control of the item. If you die your wife is now illegally in possession of a NFA item, which is a big no no. Also if you run to the store and leave your wife at home with your suppressor on the kitchen counter shes illegally in the possession of an NFA item. If shes on the trust all of these problems are avoided.

Current stuff will be ok, its already owned by the trust... now things that arent in your possession yet, or things you buy after (if it is) it is enacted? well they are TRYING to make every one on the trust be finger printed and go through a back ground check for each item... so it becomes a huge hassle with no added benefit. And as we justsaw they will change their minds an make us jump through imaginery hoops regardless if the law is interpretted or not.

My suggestion: get a trust QUICK. Start buying everything you want as fast as you can. Form 1's are taking 28-30 days right now on the efile system. I definitely am doing 1 next week.. and i may do 2. Just because if I dont do it now with a short wait time it may be a huge hassle in the future.

If you procrastinate (rito) you may end up taking all the new unnecessary steps.

                    This is all JMO

Only for form 1, 5, 6 i think. Only one that matters to you and me is f1. They are still running the scheduled downtimes. I forget the hours though. They are listed in a post on here somewhere.

Bottom line: if you have ever seriously thought about getting an NFA item, do it before 2015. If we're wrong, you'll have a fun toy to play with. If we're right, it'll be the last one any of us living in the big city (with political CLEOs) ever own.
