    See the difference?
I stand by my assessment of the exception. You can have and hunt with a firearm in October as long as you don't have a bow with broad heads at the same time.

If you could have both and just say "oh, in just hunting hogs, exotics, etc. not deer hunting", then what would be the purpose of the part about not being in possession of a gun with broad head tipped arrows during the archery only season? If your scenario were correct, they totally contradict one another.

Where the difference lies is whether or not you can prove you are hunting those exact species and not hunting deer. Im not saying your argument or Mikes argument are either wrong or right, you both are making a valid argument. Just stating that you will more than likely have your back against the wall if a GW sees you bowhunting in archery only season and have your pistol and its not concealed. You will have a pretty tough time convincing him that any game animals where not on the menu.

Mike, they do sorta contradict one another. Where in the world would you be able to hunt pigs, exotics and so on and not be in an area where deer are in the area as well.

Yep, which is why I asked the question previously (post #11) about carrying while whitetail hunting or just carrying.

I was relying on my earlier post.

I don't see any contradiction at least in my interpretation of the statute.

I agree you can hunt any animal except game animals in October with a rifle. I do not agree that you can hunt non game animals in the archery only season while carrying both a bow and a firearm at the same time.

To me it makes it perfectly clear that you can't have a firearm and a bow with broad heads attached to the arrows at the same time in the archery only season while hunting.

Does anyone know where the actual law is located. Not the law as stated in the Outdoor Annual, but the actual text of the law under the Parks and Wildlife code.

Technically isnt the burden of proof on the state? To prove you are hunting a game animal?

your not going to get into a toe to toe gun battle with them ,when shots get fired everyone is gonna start scrambling.

I'd rather have a pistol and come across some illegals or drug runners that have an AK than have only a bow and come across some illegals or drug runners that have an AK

Mike, check with a GW. The note below the bh tipped arrows allow you to carry if your not after turkey, wt or mule deer. That is the exception to the law.
Just like now there are exceptions to carrying concealed in a church/hospital were it still states you can't.
To be safe one might give a courtesy call to a GW like when spotlighting hogs at night.
                    Or get a CHL...

Get CHL is the best solution IMO.

I did ask our game warden about this exactly thing last season and be told me verbatim the point I am arguing.

You can have one or the other, but not both at the same time.

I think a game warden needs to chime in... I have a chl and always carried while hunting... but its my property so legally I dont have to conceal it. I get around it all though because I can carry my duty weopon anywhere.

Where it all arised from was people shooting deer with a gun the shoving an arrow through the hole

No open carry in the woods? If this is your private/leased property, I would think you could carry it. Am I wrong?

Texas Penal Code allows you to open carry on your property but the hunting regulations do not differentiate between private land, leased land or public land.
