    CHL question

Is it illegal for your extra magazines to be visible when you are carrying if your weapon is concealed?

    #2
Good question. I'd say probably ok to be seen since it's not a weapon but I still keep em concealed because I don't want to risk it.

Very good question tho. I'll wait for somebody that knows more about it than me to chime in.

Just curious as to why the extra mag would show and not the pistol? Is it the type of holster or are you just wondering for curiosity sake?

Thats a very good question. I would think it would OBVIOUSLY draw attention and questions... You just Know some idiot would call and turn you in though...

The right to carry a concealed handgun with a CHL in Texas is in Chapter 411 of the Government Code. Section 411.171(5) of that code says that a "handgun" has the same meaning as defined in Penal Code 46.01.

          PC 46.01(5) says....
"Handgun" means any firearm that is designed, made, or adapted to be fired with one hand.

Going by the definitions listed, I see nothing that mentions magazines, gun parts or ammo. It only says "a firearm".

I don't think a magazine qualifies as a firearm under the intent of the law but if I am carrying under a CHL, I might not want to be the test case.

Letter of the law, no, it would not be illegal if the firearm is concealed. Not adviseable though for a number of reasons...

What would the idiot turn me in for? carrying a magazine?

My question comes from a situation that I witnessed the other day. Wind blew a guys shirt tail up. I saw his magazines clipped to his belt. It got me wondering what a LEO would have done. That is all. Just wondering.

Nothing. Even if it was his firearm you saw, he was not breaking the law. The law says its illegal to intentionally fail to conceal.

DPD stood behind me at 7-11 the other day and as I got my wallet out of my back pocket he saw my extra mag on my belt and said nothing. I'm sure he knew it went with something...

Why would you want to draw attention to yourself? May be legal but not wise.

If he was curious, he could check and see if you had a CHL.

No one said anything about wanting to draw attention. Just wondering what the law was on the matter. I have nothing to hide from a LEO either. If he wants to question me, so be it.

Heck, I've been thinking of wearing a bandolier filled with ammo...
