    please help ,advise

    My wife was given land from her grandpaw ,all the title papers were did in1996 he passed away a few years back nothing was probated,grandmaw passed away they just did her probate and the aunt says the grandmaw never signed the papers by the grandpaw on the deed he gave my wife . I have built a house on it 6 years ago me my two girl's and my wife with our own hands. We have all the deed papers and have been paying taxes for some 15 or so years. Wanting some free legal advise. Thanks

    So are they saying you don't own the land anymore?

    If you've been on it uncontested for so long, it may be yours.

      So far she's just said everything was given to her.and just said the grandma never signed nothing but she's the one that first wanted us there

        My wife was raised by her grandparents from age 3 or so and had guardianship.

          gosh I hate to here this stuff. bottom line you gotta get an attorney quick. I know it's not what you wanna hear but you probably already knew that. the fact that nothing was ever signed is going to be the big big up hill battle. the thing that you have going in your favors the fact that you all the stab list homestead on there which may help your situation. why your situation is a little more complicated about the best example I can give is when someone dies in forget to change the name of the beneficiaryn the life insurance policy. for example changing the name of the beneficiary from ex wife to current wife. everyone knows that most likely the deceased individual would never want to give the ex wife the life insurance money but the fact is is what's on paper. I assume when grandfather died everything transferred over to grandmother and when grandmother died everything reverts back to her will.

          bear in mind I am NOT an attorney just sharing some examples and stories and experiences that I've been around in heard of. money and material possessions have a way of changing people in times like this. it just sucks. everyone in your family probably knows darn good well that her grandfather gave her the land that yall built the house on

                Is this in TX? I work with a bunch of lawyers that deal with land issues everyday.

                    no kidding. this should serve as a reminder to All of us to have our stuff in order and remind other loved ones to get theirs in order so none had to deal with this kind of stuff. the passing of a loved one is hard enough to deal with

                      I am wanting to say if if you pay the taxes on a piece of land for so many years it becomes your property even if it was deeded to someone else, but I am not an attorney, might PM Grayson, I know he is an attorney and there are a few others on here but he is the first that came to mind.
