          Any Government agency or person can make laws (rules that can be enforced by criminal or civil penalty) IF there is a legislatively enacted law giving them that authority.

          An example was the recently and much debated issue in Grayson County about allowing gun hunters for deer. TPWD was holding hearings on whether to change the rules. How can TPW Commission change the rules if they are not the elected legislature?

          The answer is simple. The legislature passed a law that was signed by the governor giving them the authority to set rules for hunting or fishing. I think recently TPW Commission reduced the limit to speckle trout in south Texas to three speckled trout. I am fairly certain that is enforceable by law up to arrest. Did the Governor call an emergency special legislative session and there was a heated debate but the legislature passed the 3 fish limit as signed by the governor? Or perhaps TPW Commission had the required public hearing and then changed the rules/law…. as allowed by the Texas legislature at some point years ago.

          State and federal laws and sometimes city ordinances give certain groups or persons the authority to make rules enforceable as criminal and/or civil penalties.

          I have not read the US Code on the lawful authorities granted by Congress to them but it is likely that ATF has some legislated rules making authority.

            Kinda like back when he was pushing "our crumbling infrastructure" to get the Omnibus passed... then the bridge in Pittsburg collapses hour before his speech there.
