    vaccine mandate?

    I got an email last week saying I have to get the jab by 12/8 or I get the axe. I work from home 100% of the time, and did before the rona even existed.

    I don't have a cube or office onsite anywhere, nor do I have a need to step foot into any building to do my job.

    Question is, with Gov. Abbot saying no Texan can be forced to get the vaccine with GA-40, can my company fire me if I refuse or can I cite that EO?

    Does that even mean anything to a large company with employees all over, or would it just apply if their headquarters are here in Texas?

    Edit: I really don't care what they say, I'm not getting that vaccine! I was looking for a job when I found that one.

      Imagine a world where nobody showed up to work in protest of the mandate. I bet this whole charade would end pretty quickly.

            Part of that rule is "or test every week". Tell them you want them to provide the osha mandated testing.

              My first thought is, yes they can fire you. You can fight it in court however you will be terminated until you win the case or a company, gives up on the lawsuit. You can certainly cite the governor’s order but that probably won’t get your job back. That might be the basis of a lawsuit if it is held that the governor has the authority to issue such an order. I have serious doubts as to the validity but if a lawyer could find a way to uphold the executive order, that would be awesome.

              Another thing I am wondering, why is your employer doing this? It is because of the Biden mandate or OSHA rule or is it just your company making rules?

              If it is just your company deciding on a new rule, think you would have a harder time winning in an at will state like Texas. If it is from a new OSHA mandate, I believe the 5th Circuit federal court just ruled that it cannot be enforced for now.

              Do you have a contract setting your working conditions?

              In 37+ years, I have worked with a few police officers that were terminated. I believe all but a couple got their job back. Even the union lawyers tell us, we might win in the end but your chief can fire you and until we win in binding arbitration, you will be without a job. It usually took about nine months to a year to go through the system. In our case we had a contract to back up the claim of wrongful termination but even then the officers had to go to almost a year without their usual paycheck.

              I would hate to think if we had to file a lawsuit and wait for that to go through the system.

                    100% can fire you regardless of what abbot implemented.This whole mandate thing is legit communism. Walking away from a 6 fig job, health insurance, etc very hard to do though

                      I was vaccinated due to a job mandate. The job is big money so hard to walk away. I knew it was high risk due to some previous allergic reactions to meds.

                      Had an allergic reaction to the vaccine and 3 months latter remain under a doctors care. They have no idea what to do. Fortunately the reactions only leaves swelling in my back that looks weird but I can function. Unless it turns into something more (who knows)

                      So I'm vaccinated and I have a card but I don't carry it. If a restaurant ask to see it I walk. I don't judge either way but the decision isn't as simple as "just get the jab"

                        It’s my understanding that remote workers are not required.

                        Note: Remote employees are included in the count toward 100, but are not required to be included in the vaccination/testing policy.

                          That's scary stuff. I pray it gets better, not worse.
                          Let me guess, your employer takes no responsibility for your adverse reaction either? They should, as should the federal government.

                            I’m in the same exact boat. 100% remote with no physical office to go into if I wanted to. Same date deadline. Six figure job that I will be walking away from. Even if they extend the deadline I’ll just be getting paid while I find another job. The tricky part is finding one that won’t eventually do the same thing. Hang in there.

                              The course on this is a religious exemption. Find a good labor law lawyer to help your request remain as compliant with Title IIV of the civil rights act to give you the strongest chance to be approved. Most lawyers are charging about $500 tops for the help.

                              Once approved (because Title IIV makes it pretty hard for them to deny, honestly) you have probably the greatest case for reasonable accommodation I have ever heard of. Your requested accommodation would be to continue working remote from home, as you always have, and the company would be HARD PRESSED to explain how that accommodation is an undue burden on them.

                              You don’t have to be affiliated with any specific churchC denomination, or specific organized religion to get approved for an RE. You simply have to explain how getting this vaccine would be against your sincerely held religious beliefs.

                              EDIT:
                              Another benefit of going the religious exemption route is that if they fail to follow the existing state and federal laws regarding descrimination (regardless of what brandon’s admin says) you have a civil rights lawsuit (religious descrimination) that you have an extremely good chance of winning.
