    Yeah they do. Since the mid nineties I’ve delivered them to convenience stores and others for a living. Most of those years were spent working overnights in Oak Cliff, SE Dallas, Pleasant Grove, the Wards of Houston, Sunnyside etc to punch above my seniority level, I started back when gangster rap ruled the world “being real” was being pushed from pop culture, and no one had even dreamed of gentrifying anything. From simple rip-offs to being robbed like in the movies by a robbery crew, I’ve been there.

    The problem with Qualified Immunity is that to overcome it, the exact same issue has to have been already ruled on by the courts and have established case law. Since, for example, no court has ruled that [insert issue] is not allowed then cops simply say I didn’t know I couldn’t do this and the courts ask the plaintiff where is the case law saying that the cops couldn’t do what you’re in court for and the plaintiff can’t give an example because it’s never been ruled on and the case is dismissed, so the issue is never allowed to be decided and case law on it can never be established.

      Thanks buddy, you and I have made a few of the mistakes I mentioned earlier together lol. Worst part about discussion on the internet, hard to not lower the sword due to not having personal reaction as you do in face to face conversation.

        Not sure I follow exactly what you’re saying other than you were maybe robbed delivering cigarettes? People have been killed for their shoes in those areas too. I don’t think you’re following the gist of this conversation.

            Welp, this dude was pulled over by HCSD, had a bag of weed in his truck, ticketed and let go. Then went on the kill 3 people. That would never had happened to a white guy.

                        Not exactly true. Officer has to violate clearly established law to be held personally liable. Prior cases are often used to determine if it was clearly established, but that is not the only legal test. Cases do not automatically get QI if it is clearly obvious that no reasonable officer would consider their actions constitutional.
                        Ill put it in perspective for some. In Texas, anyone has the right to protect and recover property from another to prevent the consequences of theft. You also have the right to use force, up to and including deadly force if it is believed anothers life is in danger. However, time and again when speaking to non-leo or hearing it in license to carry classes, it is the common saying to 'not get involved if its not you or your loved ones'. The reason being you dont want to open yourself up to civil liability.
                        If QI is taken away, then LEO can be personally sued, justifiably for not, for anything they do at any time. Just because someone didnt like the outcome. How many officers do you think will still go out and be proactive or try to stop people at that time? Its already clearly established law that police have no legal mandate to protect you or your property. Most departments already dont pursue for most offenses unless its a violent felony.
                        House broken into and the suspect speeds away? No pursuit
                        Business burglarized and all your money stolen? No pursuit.
                        Those are property crimes to many departments. Not worth the liability of a vehicle pursuit. Some departments dont even allow foot pursuits anymore.
                        Its all getting one step closer to federal police.
