felony murder?

    felony murder?

    Been seeing the stories on the Goins murder trial on the news down here in S. E. Tx. They keep emphasizing the charge of felony murder. Is there any other kind of murder other than a felony? Just asking cause I may be a little ignorant on this subject!

    Who knows, but I do find that odd as well. I'm sure it's just weird legal wording.

    I hope that dude suffers. Likely plenty of other involved that need to go down as well.

      It's a specific charge. Filed it several times. Prosecutors may not be able to prove the level of intent/participation to get a regular murder or capital murder. So "Felony Murder" is filed. Defendant engaged in activity that a reasonable person should have known could lead to the death of someone. Not exact wording....but you can google the penal code statute. Goins didn't set out that day to go kill two people. But he should have known that entering that house under false pretenses could lead to the death of someone. He got what he deserved. Looks like he got may die in prison (60 years sentence just handed down).

          Above average chance he could die in prison regardless of the length of sentence. He should be begging for PC now.

            In Texas, felony murder is a first-degree felony that occurs when a person commits or attempts to commit a felony and, in the course of doing so, kills someone. The felony murder rule applies even if the murder itself was unintentional. The theory is that the underlying felony demonstrates such a disregard for human life that the defendant should be held responsible for any resulting deaths​

              I think there might be a decent chance if the case being overturned on appeal on the felony murder charge.

                  Too much to type. Just google officer gerald goins arrest. Got too big for his britches over a long time of working narcotics. Ended up getting in a shooting and his team killed two people in a house that they never should have been in.

                    What was the actual felony that he was guilty of?

                        Felony Murder was the charge he was found guilty on...deaths occurred during the commission of a burglary (I think that's how they worded it since they had false pretenses/no probably cause to enter the house).
