I have a friend who will keep the water bill in his name and add it to the cost of the rent. So if his renter decides not to pay he can go down and have the water cut off. They will not stay long after that and I believe if they try he said the city would move them out.I have good luck with an application fee that will be taken out of the deposit if they move in. 75% of the fee is returned if they do not get the house. They will run from the application fee if they are a risk. Ive had good ones so far but I know its coming.

If 10 days have passed since they stated they would be back then you "should" be free and clear. First, they are in voilation of the rental agreement, second, they gave you notice they would be back the next day for the remainder of goods. If it was mine, I would have it cleaned out by Sunday and everything at the street(if they do trash pick up) or haul it to the dump.
If they came with a U Haul and moved the majority out, then they are out IMO. I would get back to business and get a tenant in there.
I know you are a good guy and are wanting to do the right thing with their possesions. If you know where they are residing and it not too far from your place, drop by and tell them they have had 10 days to collect their belongings and you will put them at the street if they want them on "X" day.Last edited by Mike; 08-13-2009, 05:42 PM.

I am pretty sure that Texas law would prevent the landlord from denying a basic, provided service as a ransom of sorts. It would be extortion more or less. The tenant has rights and I would think that it could turn bad for the landlord in an instance where he cut the water off.
It would be the same as placing a padlock on the water or gas meter to deny service to the dwelling and the landlord can't do that, only the service provider.

Call your local courthouse and speak to somebody about what is required to do a legal eviction in Texas. I know in Cali, but the laws vary greatly state to state. Most people pay a lawyer to do what they can do themselves- but you MUST follow the exact process in the law, down to if a lease has a middle name, the paperwork must have it too (in Cali at least). Get them out.
As far as the $4k, I think you're burned. Get them out 1st.

I elk hunted with a guy from Michigan, and we got to talking around the campfire about stuff, and deadbeat tenants came up. He said his Dad had a number of rentals, and he had a woman move in and start 'the game' saying it was infested (it was not), she knew her rights, she didn't have to pay any rent, yada, yada.
He said his Dad calmly and quietly listened to her, and said, "I know what you're up to, you're screwing me. And here's what I'm going to do. If you're not outta here by 5 pm tomorrow, I'm going to the local biker bar, and I'm going to slap an extra front door key on the bar, and say there is a single woman in his apartment who is screwing him for rent, she keeps an extra key under the front door mat, and I need somebody to return the favor".
She was out well before 5 the next day.
I wouldn't not mess with his Dad, or him.
