    Release of lien on property

    I paid off a piece of property on a sale by owner and I need a release of lien to file at the court house. Does anyone have any experience with this? Is it something you can do yourself or do I need a lawyer. Thanks for any free advice.

    You might call a title company to first run a title search to confirm liens. I'm sure they can help you with a release, too.

      You can do it yourself but you need proof of release from the l8en holders. Call the county clerk and find out what you need.

          I sold a piece of property, did a deed of trust thru a title company. They paid off it off recently and I went back to the same title company and had them draw up the release of lien.
          Our county clerk office was zero help.

            We paid off our house in December. The bank sent us a release of lien earlier this month in the mail. I took it down to county clerk for them to scan it, charge me $28 and file it.

              This was a sale by owner, no bank involved. My friend is a real estate agent and she did the contract for us but she can't help with this part. I'm told I just need the form to file at the court house, I can't find where to get the form. Hopefully the county clerk will have an answer.

                There is no OFFICIAL form but you need to have the lien holder complete the release. It should include the same information that was on the original lien so the proper information is released. You can go online to you COUNTY CLERK and look for a release of lien (search this document) so you can get an idea of format.

                  The person or business who placed the lien needs to send you a release of lien. Then you just submit it.

                    Not sure if this applies to all situations but when we have had to deal with liens in the commercial construction/real estate world we just need to get a final unconditional lien from the person/company that filed the lien and then I went down to the tax office I believe to get the lien released.

                      Any release of lien document you get from the lien holder needs to be signed in front of a notary by both parties. My wife does these all the time for our hoa. Those liens are filed by an attorney and are released by the same attorney.

                        Did the seller finance the property with a Deed of Trust or Contract for Deed? Either way, he/she needs to sign the release although you can prepare it or have a title company prepare it. Then the release needs to be recorded in the deed records of the county clerk's office.

                          If you had a title company “help” you, they just had a lawyer draft it for them/you.

                              You need to pay someone to do this right while the sellers are around and willing/able to sign the proper documents. Either call a lawyer (Grayson who posted above would be good) or a title company that has a lawyer in house.

                              Depending on what your realtor friend prepared, you might need a release of lien, or you might need a deed.
