Quoted from Texas law as cited in your paper:

Texas Occupation Code Chapter 169

"Low-THC cannabis" means the plant Cannabis sativa L., and any part of that plant or any compound, manufacture, salt, derivative, mixture, preparation, resin, or oil of that plant that contains not more than one percent by weight of tetrahydrocannabinols.

That if the definition I gave.

"Medical use" means the ingestion by a means of administration other than by smoking of a prescribed amount of low-THC cannabis by a person for whom low-THC cannabis is prescribed under this chapter.

This shows that it can’t be smoked THC.

Sec. 169.002. PHYSICIAN QUALIFIED TO PRESCRIBE LOW-THC CANNABIS TO PATIENTS WITH CERTAIN MEDICAL CONDITIONS. (a) Only a physician qualified with respect to a patient's particular medical condition as provided by this section may prescribe low-THC cannabis in accordance with this chapter to treat the applicable medical condition.
(b) A physician is qualified to prescribe low-THC cannabis with respect to a patient's particular medical condition if the physician:
(1) is licensed under this subtitle;
(2) is board certified in a medical specialty relevant to the treatment of the patient's particular medical condition by a specialty board approved by the American Board of Medical Specialties or the Bureau of Osteopathic Specialists;

This shows that it can only come from a physician that is a board certified specialist in that particular field.

Sec. 169.003. PRESCRIPTION OF LOW-THC CANNABIS. A physician described by Section 169.002 may prescribe low-THC cannabis to a patient if:
(1) the patient is a permanent resident of the state;
(2) the physician complies with the registration requirements of and
(3) the physician certifies to the department that:
(A) the patient is diagnosed with:
(i) epilepsy;
(ii) a seizure disorder;
(iii) multiple sclerosis;
(iv) spasticity
(v) amyotrophic lateral sclerosis;
(vi) autism;
(vii) cancer;
(viii) an incurable neurodegenerative disease;
(ix) post-traumatic stress disorder;

This last section shows the only conditions that are allowed for this low level non-smoked THC.

Hemp derived THC is perfectly legal in Texas. You can get THC seltzers at Specs.

I have a Buddy that was arrested in Benbrook, Tx by City Police for a Delta9 Vape pen legally purchased in Oklahoma. Released from jail on a personal bond. Hired a Tarrant County Attorney and $7500 later, Tarrant County DA dimissed the charges. Sounds like a Racket to me!!!

Local news did a bit where several teens in Cameron Co were offered some sort of class / course to where they were able to flush their felonies due to the vape deal...had no idea vaping it was bad, but the real / traditional stuff is kinda ok??

He said he did not. They sent pen to Lab for testing. Never went to Trial. DA just dismissed it. Just a racket, like I say!!

When it’s made into an oil or whatever it is and is placed in a cartridge it’s then a controlled substance and is a felony. Same thing with dabs and anything that is taken out of flower form. Hell even having gummies on you is a felony.

It's actually THCA in the vape shops here in NC. It's available in gummies, vapes, or the actual flower. THCA is a legal product, but it's chemical structure converts to THC when it is burned. Some of it is pretty potent. I don't smoke anything, don't vape or eat gummies. One of my friends has a store, he keeps me up to date on it. All I can say is his regular customers drive crappy cars, live with family and seem to waste a lot of oxygen by existing. Not much ambition present.
