Our Mom passed away in March and had everything in order. She had set up a trust in 2016. She left me and my brothers hand written instructions on how we were to handle her possessions.
She had picked out the songs and had the order of her funeral arranged. She and our Dad had pre paid for both their funerals in 1997. She also had the clothes she wanted to be buried with in a hanging bag.
I was the sole trustee and everything went smoothly and all her asset were divided equally among the four of us. There was no family discord.
It motivated me and my wife to set up our own trust recently. We used the same estate lawyer Mom had used.
He explained that a will, going through probate, can cost between $6,000 to $7,000. He put together both our trust for less than $4,000.Last edited by Froggy; 12-01-2022, 12:50 PM.

When I lost my sister, her benefactor was my son, who was a toddler at the time. Her intent was good, but it’s been untold pain to put it to bed. We had to start a conservatorship, which is essentially a court ordered trust with strict rules for investing or drawing on the money. We spent a few thousand with a lawyer and have been to court a couple of times to go before a judge to simply get his money from her 401k and life insurance over to his investment account, which we cannot touch. Losing her was difficult, and the whole conservatorship ordeal was salt in the wound for months.
It’s all okay now, and l understand it’s to protect a minor from unscrupulous family, but long story short, start a trust if you’re going to leave any minors as heirs.

while we are on this subject allow me offer a PSA -
If you are married and providing most of the income for your wife and family please look into getting a proper amount of term life insurance to replace your income if you were to pass away.
It is easy and very inexpensive - but if you truly care about your family do not leave them in a position where they cannot live the same lifestyle they are living now.
I have seen it over my career many times where the surviving family was left in a huge bind because they not only lost their father but also their income -

I have most of those items covered for my Family financially. Great list and thanks for posting it. My Wife works in insurance so we are organized with this stuff. About seven years ago I added all of my hunting gear to the list so my son would be able to either take over my spot or take all of the gear off the place. Blinds, ladders, tripods, feeders, cameras, UTV, trailer keys, lease member contact info. I wanted to make sure my son and daughter have all of these items. I do not want it to go to waste.
