    Selling a house(Neighbors think they own the side yard)

    Long story short, my grandma passed away this year and she owned 4 rent houses in the little town she lived in. My mom inherited one of them and wanted to sell hers. The real estate agent just sent this picture to my mom showing what the neighbors have done. The audacity to think they’d get away with this is hilarious. Obviously the property line is where you see the fence in the back.

      There is a typical 5-10ft setback they should be told to tear down that stuff it will cause issues at inspection/closing

            What will be more ridiculous is when they claim that since it's been like that for so long they can now keep it that way, and somebody higher up probably will agree with that logic, and somehow you'll be in the wrong hah...smh.

            Hopefully just a conversation and it goes away.

              So, have you or the realtor or anyone, for that matter spoke to the neighbors? Maybe they had a verbal agreement with your mil? I’d simply make an inquiry before jumping to conclusions.

                  I haven’t seen this particular house in several years, but I know it wasn’t that way. The realtor said it’s was done within the last week or so. If I didn’t live 7 aways I’d be there this evening showing them the survey and the property line and I’d be tearing that fence down. If you look close, they even poured a slab over the property line.

                    My grandma has owned it for 40 years, and always rented it out. No renters have been in it for 6 months while we had people fixing it up to sell. I highly doubt they got permission from anyone.

                          i'd have a discussion before you go do anything. never know what the story might be. you live 7 hours away. they may have something in writing from mom. who knows? If they don't, go handle it.

                              This same situation happened to me on my first house - the neighbor poured a sidewalk on my property. He kept referring to it as the 'common area' even though the survey showed otherwise. I finally got an attorney to write him a letter, and he countered with the 'adverse possession' claim. We went to mediation and he ultimately settled with me - had to repay my attorney's fees, remove the sidewalk and replace all of the landscaping he removed. Crappy situation - good luck!
