    Academy Sports and NICS

    I love the deals at Academy. I just tried to buy a couple of guns there and found out they don't follow the law on NICS. I got a delay and after three days they are supposed to release regardless but Academy has a policy to wait for NICS approval.

    All of these big box stores are not releasing firearms. I just can't shop at a place like that. Support your local firearms dealer.

    While Brady law does not prohibit the transfer after 3 days, I would be extremely surprised if even local stores would assume the liability of making the transfer without approval.


    Just get your CHL and never worry about it again.

        It is up to the store whether they release or not, they are not required to.

        I have an FFL, and regularly release per Brady date. Lots of NICS searches are never even updated to show cleared.

          It is simply because of the lawsuits they have been involved in because of previous releases that have ended up involved in criminal activity. It is not them going against the 2nd amendment but them trying to protect themselves......... sad, but that is the way of the world.

                    My understanding is that if an FFL releases a firearm after 3 days without a response from the NICS, and then the background comes back denied, it's up to the FFL to retrieve the firearm. I am not 100% sure that's the law, but that is what I always heard. If true, I support any FFL who refuses to release a firearm until they get the background check back as proceed.

                      The law does not say they have to sell after 3 days. It says “can” after 3 days. Big box will protect their best interest over yours. Academy gets sued all the time. They will protect their assets. Can’t say I blame them for waiting on a proceed.

                          And… you can’t blame them for not dicking with BATFE, because they make up the rules as they go.
