And, not to forget that Chris medical bills and salary was paid for, as he was hurt while poaching. Yes, who is the Captain?

        Mike Long says hi!

Kellen Ellis had just weighed in the heaviest limit of the field on the first day of his second-ever bass fishing tournament, one of the biggest in San Diego County. The then-18-year-old was flying high. His day got even better when the rock star of California big bass fishing walked over to say...

They won't, I fished a Bassmaster weekend series event years ago that was won buy a guy that had previously been caught cheating, they were happy to take his entry fee money and DQ him after the weighin even though he brought in the biggest bag. The Tournament directors in the state have a list and these 2 little turds are on it now.

Heard a story about a Basschamps tourney where another competitor saw him in his boat pulled up under a dock asleep through most of the tournament. It was tough conditions and most teams struggled to scratch out a limit. Somehow Rose was able to sack up a huge bag, solo, while spending most of the day napping under a boat dock.

I guess it’s always been that some parents fail miserably at raising their kids or set bad examples for them to follow. Cheaters have always been around and dang right the consequences should always be painful. Just terrible

In this case it would be a little more than a pride issue.

From the story in this case, it appears to be a misdemeanor involving juveniles. They cannot be certified as adults for a misdemeanor and they would probably get six month probation and/or community service time. Maybe that’s enough but that is about the extent of the consequences.

Their records would be sealed and I believe from the ages, they would become adults maybe within a couple of months.

I am not condoning their actions and I have no issue at all with them being prosecuted. In this case however it looks like a bunch of paperwork for very little punishment. According to their birthdates, they could be adults by the time this all shakes out and their records already sealed.
Sorry but you would be wrong

Son was 12, shot a duck with a slingshot in a state park.
Charged with possesion of a weapon in a state park, Class C misdemeanor
He is now 25 and that charge is still with him.
Was a big factor that almost kept him out of nursing school.
It could be dealt with by hiring a lawyer and jumping through some hoops but at this point it has made him stand out in interviews
BTW he payed a $500 fine out of his own pocket for that ticket too

Also for anyone who finds themselves in a situation where a minor is involved in any legal situation

Maybe the law has changed or maybe it was because a weapon was used but I think Flywise is correct. Mistake that was made was they didn't let them weigh in the fish, then it would have been theft by deception plus there are Texas laws on the books now specifically concerning this in bass tournaments.

Juvenile records are sealed. In certain government situations they can be viewed. I have viewed or been made aware of juvenile records as part of law enforcement. A bass tournament should have no access to those records for entry qualifications as suggested.

I believe that certain class C misdemeanors are likely viewable (not sealed) since they are handled in JP Court or City Court and do not go through the class B or above restrictions of the Juvenile Justice system…. but I am not positive. Basically if an officer writes a 16 year old a traffic ticket and he pays it, it will be on the city records and does not go through Juvenile processing. A misdemeanor B or above (just like for an adult) has to be handled by the county in the Juvenile Justice system.

Citations can result in sealed records if referred to the juvenile probation or justice in a county for repeat offenders. I don’t remember the rules now but it was like five citations in a year could be considered delinquent conduct which rises to the level of a misdemeanor B or higher.

Being a runaway is similar to a class C citation. How remember this one girl about 15 years old we arrested about half a dozen times for being a runaway. The Juvenile Probation officer got tired of dealing with her repeated warnings and probations and filed under delinquent conduct and she was eventually sentenced to about six months in TYC. When I picked her up for that sentencing, she cried like a baby because she did not believe they were going to actually file on her as a runaway. So basically she was sentenced to the county jail or could even be considered juvenile prison for a class C. At that point the class C becomes a sealed record.

To the issue of this thread under fraud, it would be sealed.

Absolutely. Why would a nursing school worry about a 12 year old getting a ticket for using a slingshot. Ridiculous…..

… and not wrong, it is just a citation as opposed to any higher charge. Of course in this case “just a citation”was almost disastrous.
