First, AHS is in big trouble. A civil law suit is the least of their problems. Heads will roll.

As for the male student, it'll depend on the severity of his retardation if he'll ever be brought up on federal crimes. Shame on Alvin following the advice of some stinkin lawyer. They should do the right thing.

Explain how the kid would face federal charges in any situation? Sexual assault even of a disabled person is state crime.

I think the biggest issue would be culpability due to his disability and whether or not he is fit to stand trial.

OF or FROM a disabled person. Im genuinely curious how it would be handled considering it sounds like the boy is a mentally disabled student as well. from what i gathered from the article he doesnt seem like a regular healthy highschool student

It becomes a Fed thing because her rights were violated and she is Special Ed and falls under IDEA, federal law, as well as the suspect. And you are right that apparently the suspect would not stand trial as well for his mental incapacity.
It should all fall on AISD for dereliction of duty and they will surely pay.

After having been privy to lots of goings on in our school for years now it’s exactly what I’d expect. The main focus is the football program, next is basketball, and personal responsibility is way down on the list.

If their focus is on the football program they may want to find someone else
the softball program is pretty good

Im not defending him or saying i wouldnt do something about it personally if it were my kid. Id be furious, im just wondering what his mental compacity is in the aspect of rational decision making.

So just because he's "disabled" he gets a free pass? He ain't near as dumb as he's made out to be if he's raping someone. If a dog attacks someone what happens to that dog? It gets euthanized more times than not. One could make the argument that the dog was just being a dog. The person ran and it thought it was time to play and things got out of hand. I ain't buying none of it. Some people need to be euthanized too.

Oh I know. I was just pointing out that I don't think he's nearly as disabled as we'd like to think. Probably no more than the rest of us that have a hang down. I've made some pretty retarded decisions in my life because of women. None to that degree but I know some fellas struggle with rapin. It happens.

I agree and im sure weve all done some dumb stuff. Its easy to think with the wrong head. Hopefully the family can get it sorted out and justice served whatever that may be. Hard to to say when there are so much info left out of the reporting.
