    Questions for LEO's

    Is there any law considered broken where a LEO can give a citation to someone for flat out lying to the officer?

    I ask because my son was in a fender bender. Other guy ran a red light but claimed my son ran a red light (which didn't make sense). Not saying that alone but if my son would of had his new dash camera plugged in it would have been 100% obvious the guy was bold face lying. Luckily there where 3 witness in the car directly behind my son that the LEO took the time to call and verified the other guy ran the light.

    I just think it's BS people can lie like that with zero consequence.

    What if this went to court and the guy lied to the judge and then the dash cam video came out. Could the judge fine someone for lying in court? perjury?

        I'm no LEO, but I think it is a yes & yes. Giving a false staement to LEO #1 and lying under oath #2

        I put a dash cam on my son's truck. I hope he still remembers to turn it on.

                    It is not like a traffic citation or a class C misdemeanor. It is a class B misdemeanor so up to six months in jail and/or up to a $2000 fine.

                    As such, it has to be prosecuted by the district attorney. I have never heard of a district attorney taking the charges and tying up the courts in such a case. I have filed it for more serious offenses such as information in a shooting, etc.

                    This is the actual law if you wish to look at it.

                    Sec. 37.08. FALSE REPORT TO PEACE OFFICER, FEDERAL SPECIAL INVESTIGATOR, LAW ENFORCEMENT EMPLOYEE, CORRECTIONS OFFICER, OR JAILER. (a) A person commits an offense if, with intent to deceive, he knowingly makes a false statement that is material to a criminal investigation and makes the statement to:
                    (1) a peace officer or federal special investigator conducting the investigation


                    As far as being a material statement, it has to be something that could affect the outcome of the investigation. If an officer was investigating a crime and you told him you’re on your way back from fishing and caught a 10 pound bass, unless the bass was part of the investigation, you could lie and tell a fish tail and it would not be a crime.

                    Is it a crime to lie to an officer during an investigation if the information would hinder the investigation? Yes.

                    Will the district attorney tie up a county court to investigate and prosecute someone who lies to get out of a traffic citation? I would guess that in nearly 100% of the cases to answer would be no.

                          Lying to an officer can mean a lot of things.

                          If I watch a hand to hand drug transaction and I see the dealer stuff a baggie up his butt.

                          I can approach the gentleman and politely ask if has any drugs hidden in his butt.

                          He tells me no sir, I don't hide drugs in my butt.

                          I cuff him and pull back his shorts and I see a back of crack coming out of his crack.

                          Yes, he lied to me. He doesn't go to jail for lying about the crack in his butt. He's going to jail for possession of a controlled substance.
