    Diminished Value Question

    My sons wife T-Boned someone who pulled out in front of her(not her fault). Insurance company did not total. They are spending over 33,000 to repair their 2018 Yukon Denali plus a rental for 3+ months that they keep calling for them to return weekly even though it`s still in shop. After talking to me he asked the shop owner about the diminished value of the vehicle. The shop owner, who is a very trustworthy and honest person that I know and worked with at one time, told him it would be around 20 grand. His wife even had to have surgery on her hand and have not been reimbursed by the insurance company for their hospital bills. Can HIS insurance help him recover his out of pocket expense and diminished value or does he need to contact an attorney. My wife said he was contacting his attorney today, but I think his insurance should be responsible for helping him, at least on his hospital bills for the hand surgery caused by the accident. Thanks

      She needs to get a lawyer. It sucks it is like that, but the insurance companies both will have one and will do their best to pay the least amount possible. Seriously, need to get a lawyer asap, and have them not talk to insurance, only the lawyer.

        my insurance would not help me get diminished value. i had to request it myself from the other insurance company and without an attorney they would only agree to half what i should have received. As much money as is involved in your case i would seek an attorney.

            Diminished value is a liability coverage, so it's for the other party involved when you are at fault. It's not applicable to your own vehicle.

            Now if it's share liability or no one accepts it, all bets are off.

            Texas laws aren't as straightforward on it as in other states, it's very subjective.

            It's possible that uninsured motorists could step in on DV but I've never actually heard of that happening.
