My two cents…. A mco is not a title. A manufacturers certificate of origin (mco) can be a piece of paper w all the vehicle build specifics, costs, etc. Here in Texas you can turn a mco into the tax office and the state will issue you a title for the vehicle. The mco though has to have specific information though that the state wants. It’s usually on there.

Some of the guys are correct, it’s just like a regular loan where the title is being held by the lender. I’ve never known anyone to hold a mco though. A true title yes.

Hopefully you can get it straight. It’s a lesson and a risk to buy something w a mco instead of an actual title.

Think people aren't getting some of the OP's info correctly. He didn't take a loan on the UTV. He took out a personal loan, no collateral at the bank or wherever. If he defaults the UTV won't be taken, it will just screw him up.

The dealer should have the MCO thereby allowing you to get a title. You need to talk to the dealer, I know you said you already spoke with them, but it is their responsibility to make sure you get a title. Even if they lost the MCO I think they should be able to get one from Massimo. I own a Mossimo dealership.(far from Paris TX)

You need to go to phase 2 with the dealer.

Ok, then it is dealers responsibility to give you the MCO when they get there money. They should have even files the MCO, and did all the title work and collected sales tax. You need to go at them hard, and if not, you can sue, and report them to the tax accessor for your county. Do not back down not even a little bit. First thing I would do is draft a very stern, short and to the point of what you want, what they are going to do to fix it, and a timeline of when they are to correct it, or else you will file suit.

Did they collect tax from you when you purchased? Do you have all of the paperwork still?

Every single UTV sold in Texas only has a MCO, the dealer though usually converts that MCO into a title when you buy it and pay the applicable taxes.

Yes sir they collected tax. I sent a copy of everything I had to an attorney in Tyler. He's going to look it over and get back with me on my recourse. I agree with playing hard ball at this point. I also found a document online from the TX Dept of Transportation that says any UTV sale after August of 2019 has to have either a title or MSO transferred by law. So they are breaking the law by not issuing me my MCO or title. I'll update as I get information back. I appreciate all of the help.

I had a TON of problems getting the MSO from tractor supply after we purchased our old SxS. In a nutshell, the manufacturer will send you one if you provide the VIN and receipt of purchase (should have the VIN on it too). If they refuse to then I would seek legal counsel.

If it's not listed as collateral I don't think that would be correct.

If know of two that were used on my lease. They are cheaper for a reason. The use of the word ‘were’ is also a lead in.
